The ATF can’t go after NRA members over guns with pistol braces on them. That’s the outcome of a preliminary injunction issued by a federal judge on Friday. US District Judge Sam A. Lindsay sided with the gun-rights group and enjoined the federal agency from enforcing its rule reclassifying pistol-brace-equipped guns as short barrel rifles (SBRs) under the 1934 National Firearms Act (NFA). The decision keeps any NRA member who owns a braced gun from facing six-figure fines or imprisonment if they didn’t register their gun by last year’s deadline–something most owners didn’t do. “[C]ompliance with the Final Rule is not discretionary, and the NRA’s members face severe penalties for their failure to comply with the Final Rule,” Judge Lindsay wrote in NRA v. ATF. “Accordingly, both of the final requirements for injunctive relief are satisfied because the threatened injury to the NRA’s members outweighs the threatened harm to the Defendants, and enforcement of the Final Rule under the circumstances will not disserve the public interest.”

Today’s Supreme Court is seen as an outsider institution in Washington: either a bastion of limiting government in a government town or a rogue assaulter of what Washington insiders like to call “the common good.” But this perception may be increasingly obsolete, thanks to a trend which the justices seem unable to combat and sometimes even encourage: their growing perception of dependency on an aggressive “fourth estate” of establishment journalists. As a result, the Court increasingly looks like a partisan hothouse of “personalities” — or, in the recent description of a sympathetic interviewer of two sitting justices, “a really good preschool.” The fallout from this perception affects not just the justices but also the country, denying citizens a clear view of the body responsible for adjudicating the powers of government. The media’s heightened scrutiny of the Court started in earnest in 2018 with the nomination to the bench of Justice Brett Kavanaugh, rightly seen as a new vote to overturn Roe v. Wade. Since then, no aspect of the justices’ lives has been off-limits — whether RV purchases or publishing strategies, spousal employment or house sales. […] The most noticeable effort to tread this fine line comes from Justices John Roberts and Amy Coney Barrett, and its most overt manifestation is a 2024 bipartisan public relations offensive mounted by justices Barrett and Sotomayor to convince the public that “we don’t have red robes or blue robes”; that “[we] work to accommodate each other”; that [we don’t] feel guilty looking across the […] table at one another”; and that “[we are] part of an arranged marriage with no possibility of divorce.” While well-intended, this PR offensive has serious drawbacks. Former President Donald Trump posted a $175 million bond on Monday in his New York civil fraud case, halting collection of the more than $454 million he owes. The posted bond also prevents the state from seizing his assets to satisfy the debt while he appeals his case over inflating the value of businesses, according to a court filing. A New York appellate court had given the former president ten days to put up the money after a panel of judges agreed last month to slash the amount needed to stop the clock on enforcement.

The bond Trump is posting with the court now is essentially a placeholder, meant to guarantee payment if the judgment is upheld.

Driessen: Can ‘clean energy’ schemes get any crazier?

Materials, costs and survivability for wind turbines on massive floating platforms defy reality. The US Interior Department’s Bureau of Ocean Energy Management recently designated two Wind Energy Areas in deepwater areas off the Oregon coast. BOEM is also reviewing offshore wind energy development options for the Gulf of Maine, Central Atlantic, Gulf of Mexico, and maybe Great Lakes. They’re part of Team Biden’s plan to deploy 30,000 megawatts of offshore wind energy capacity by 2030 and 15,000 MW of floating offshore wind energy capacity by 2035. Capacity is what the turbines could generate, when the wind is blowing at optimal speeds, perhaps 30-40% of the year. 30,000 MW is what 2,500 12-MW turbines could generate. It’s enough to meet New York State’s current peak electricity needs on a hot summer day. Add the electricity required to replace gasoline cars and natural gas furnaces and stoves, meet surging AI, data center and streaming video demands, and charge grid-scale backup batteries – and New York alone would likely need 10,000 12-MW offshore turbines. Meeting the soaring electricity needs of all US states would require hundreds of thousands more.

The Arizona Corporation Commission (ACC) recently took the unusual step of voting to pull back on the state’s renewable energy targets, over concerns they are too costly and produce few benefits. Most states are moving in the other direction, following California’s lead, but there are signs of some hesitation as the real costs of these policies are realized. California has pursued some of the most aggressive renewable energy policies in the U.S. Since 2008, wind and solar in California went from 3% of the state’s electricity generation mix to 25.7% last year and it pays the third highest electricity rates in the county behind Hawaii and Rhode Island.

The virus and racial justice became justifications to disregard verification methods like signature requirements. […] It is now clear that the overhaul of our election system was a deliberate initiative from the outset of the pandemic response. James: Missouri schoolgirl Kaylee Gain, 16, ‘does not know why she is in hospital’ – as lawyer makes shock admission about vile WWE social media posts

Kaylee, 16, from St. Louis, was initially left in a life-threatening condition by Maurnice DeClue, 15, who repeatedly smashed her head into concrete during a violent altercation. She suffered a skull fracture and frontal lobe damage during the violent March 8 brawl that was caught on camera near her high school, but has since been released from the intensive care unit. A lawyer for her family revealed that Kaylee has been able to engage in ‘limited verbal conversations’ and has gone on a few short walks with the assistance of hospital staff. Kaylee’s parents have slammed their daughter’s accused attacker, who is in custody, and demand that she is tried as an adult.

Several students at Vanderbilt University were arrested and placed under suspension after occupying the chancellor’s office building to protest the cancelation of a boycott, divest, and sanction campus-wide vote. […] Video posted to Instagram by VandyGenAction, a group that also participated in the sit-in, shows a student calling 911 to report her friend being denied the “right to change her tampon.” “There is currently a female student who is denied the right to change her tampon that has been in multiple hours, which leads to an increased risk of toxic shock syndrome,” the student says.

”Ma’am, do you have an emergency?” the 911 operator responds, while trying to determine if the student is requesting an ambulance. A separate video posted by the Vanderbilt Divest Coalition shows a protester on the verge of tears arguing with police over whether the student in question would be arrested if she left to change tampons.

BlackRock is duping investors into thinking its “non-ESG” funds aren’t driven by ESG criteria and is also falsely leading investors to believe its ESG funds maximize profits, the order says: “BlackRock made untrue statements that certain of its funds do not incorporate ESG considerations. As detailed extensively in this order, BlackRock stated on multiple occasions either expressly through publications or by action that the company does in fact incorporate ESG considerations into its non-ESG funds.” […] Indeed, BlackRock CEO Larry Fink has admitted that the term “ESG” is so toxic that he “won’t say it anymore” because, when people hear the term, “We lose the conversation.” Instead, BlackRock appears to have resorted to more surreptitious means of using its clients’ money to further its ESG agenda.

I have no idea whether either was aware of their intellectual antecedents, but both were riffing off theses first fully explored for mass audiences by Sailer, a man who has arguably had a more esoteric effect on the intellectual dissident right than any figure in the last quarter century. […] Noticing is an ideal title for the book and a great description of what Sailer has resolutely done daily over the last several decades. And noticing is indeed the key challenge of our intellectually straitened age. As he wrote years ago, “Political correctness [an older version of what we might call “wokeness” today] is a war on noticing.” And Steve Sailer believes in noticing patterns that others don’t see—or refuse to see.
