A superior court judge in Washington declared that the state’s 2022 gun law banning the sale of large-capacity magazines is unconstitutional in a ruling on Monday that excoriated the state for making misleading, tortured, irrelevant, and unconvincing arguments. Cowlitz County Superior Court judge Gary B. Bashor found that Washington’s ban on the sale of magazines with more than ten rounds runs contrary to the Supreme Court’s landmark Heller and Bruen rulings. He issued an immediate injunction prohibiting the state from enforcing the ban.

If all goes as scheduled, former President Donald Trump’s trial will begin next Monday. It stems from the indictment by the elected Democratic district attorney of Manhattan, Alvin Bragg, and it is what the New York Times calls a “paperwork” case — that is, it concerns business records, in this instance records Trump’s company kept of a nondisclosure agreement he made with porn star Stormy Daniels during the 2016 presidential campaign. It’s an astonishingly weak case. […] In August 2018, Cohen pleaded guilty to five felony counts of willful tax evasion. Cohen’s crimes, evading taxes on a total of $4,134,051 in income, stemmed mostly from New York City taxi medallions he owned. Federal prosecutors said Cohen concealed income from loans he made to taxi operators as well as income received from those operators. Cohen also evaded taxes on hundreds of thousands of dollars he made in real estate deals. And, just for a little color, prosecutors also revealed Cohen evaded taxes on $30,000 he made “for brokering the sale of a Birkin Bag, a highly coveted French handbag that retails for between $11,900 and $300,000, depending on the type of leather or animal skin used.” That’s the tax evasion. Cohen’s felony false statements to banks also involved . . .

President Trump is enduring an onslaught of lawsuits calculated to bankrupt him and show trials designed to imprison him. Just a few years ago it would have unfathomable to imagine an open conspiracy of judges, prosecutors, elected officials, bureaucrats, academics, and media figures feverishly plotting the destruction of Trump through relentless lawfare in a desperate gambit to keep him out of the White House. But that is precisely the situation at hand today. One of the most powerful tools in this arsenal of lawfare is disgorgement. Disgorgement is ordinarily defined as an equitable remedy to recover ill-gotten profits arising from civil or criminal frauds and then distributing those recovered profits to victims of the fraud—a form of restitution. Prosecutors traditionally used this remedy to go after funds held by backers of terrorism, Ponzi schemes, organized crime, and other authentic criminal enterprises. When the Bernie Madoff investment fraud was discovered, the government forced the beneficiaries of the scheme to disgorge their illegal profits and reimburse the defrauded investors. However, as the rule of law is debauched, disgorgement is being dramatically reinterpreted and expanded to punish political enemies.

I just came across an article fresh from the online pages of Government Executive (“From Swamp Parasites, For Swamp Parasites” is the magazine’s tagline, I assume). It’s mundanely titled “OPM issues its final rule for Schedule F protections,” and while that may not mean much to you it’s worth us taking a closer look at it, because this is one of those great examples of where the quiet part gets said (almost) out loud. The article reports with some self-interested excitement that: The Office of Personnel Management issued the final version of its regulation meant to safeguard the civil service from the return of a Trump-era policy that sought to convert most federal employees to at-will workers. The new regulation — which will be published in the Federal Register for public inspection on Thursday — seeks to provide 2.2 million federal employees with defined protections that would make it difficult for a future administration to re-apply the Trump policy, known as Schedule F. [Emphasis mine] For context, “Schedule F” was a measure Trump came up with (unfortunately only at the tail end of his presidency) to make it easier to actually fire permanent, non-appointed employees of executive branch federal agencies, aka the administrative state or “deep state” (or, as its denizens prefer to call it, the “civil service.”)

The FBI’s ‘Ordinary Men’

Do they have to obey their orders? “Ordinary Men, the Forgotten Holocaust,” is the title of a documentary movie on Netflix which highlights German police battalion 101, which was one among more than 130 such battalions created in the 1930’s and early 1940’s. Otherwise “ordinary men” were recruited from a variety of professions and backgrounds out of middle class and educated German society to man these battalions to assist in occupying the territories that were being conquered by the German Wehrmacht. The movie delves into how otherwise every day ordinary folks can be turned into genocidal killers. Many of the mass killings of civilians, according to the documentary, were done by these ordinary German police recruits and not necessarily by Nazi soldiers. They were mobile killing units known as Einsatzgruppen. What one may not know is that one could opt out of participating in these mass executions. They were given a choice. Some in fact did opt out. […] Today I believe we are confronted with a similar situation: members of FBI SWAT teams willingly obey questionably immoral and unconstitutional orders. Blind obedience to orders threatens American citizens to the suppression of their civil liberties. The FBI has had an ongoing relationship for years with an organization that has its roots in Nazism and which calls for the genocidal killing of Jews and the obliteration of the Jewish State. That entity is Hamas, doing business in this country as the Council on American-Islamic Relations (CAIR).

A bill to reauthorize the Foreign Intelligence Surveillance Act is moving to the House floor for a final vote, likely to take place by Thursday, and an amendment to end warrantless surveillance will be considered by the full House of Representatives. The “Reforming Intelligence and Securing America Act” would extend Section 702 of FISA for 5 years, which “permits the government to conduct targeted surveillance of foreign persons located outside the United States,” according to the Federal Bureau of Investigation (FBI). Progressive Democrats and conservative Republicans have teamed up in an effort to include a warrant requirement in the FISA renewal bill. […] Rep. Andy Biggs, R-Ariz., former chairman of the conservative House Freedom Caucus, and Rep. Pramila Jayapal, D-Wash., chair of the Congressional Progressive Caucus, are part of a bipartisan group of lawmakers who sponsored amendments to the FISA reauthorization bill related to the Fourth Amendment, which prohibits the federal government from conducting “unreasonable searches and seizures.”

Whedon: Mike Johnson will delay transmission of Mayorkas impeachment articles to Senate

A spokesperson for House Speaker Mike Johnson on Tuesday confirmed that he would delay sending the articles of impeachment against Department of Homeland Security Secretary Alejandro Mayorkas to the Senate at the request of conservatives in the upper chamber.

The House voted to impeach Mayorkas in February, but has not yet sent the two articles to the Senate. Johnson was expected to do so on Wednesday, The Hill reported, while the Senate had been expected to vote on tabling the articles Thursday. Utah GOP Sen. Mike Lee had suggested lawmakers might make a more informed decision by waiting rather than voting so quickly after returning from a break.

The ubiquitous EVs charging in the driveways of seven figure mansions are shadowed by solar panels on the roof and sit side by side with signs declaring, “Hate has no home here.” Neither does affordability. The vast majority of electric cars, approaching 1 million, can be found in California. Compare that to the paltry 5,000 EVs in Arkansas or even the under 50,000 in a sizable wealthy blue state like Massachusetts. The entire industry of sleek shiny cars that run on batteries only exists because California taxed other car buyers to subsidize Tesla and its emerging counterparts. California’s heavy subsidies and mild weather, its wealthy cities and conspicuously virtue signaling elites, made EVs possible, and made it impossible for them to evolve outside its warm leftist ecosystem. In fact, Biden issued a measly 94-word blurb about Easter. Despite nearly 5,000 Christians killed for their faith every year around the world, nothing was mentioned about their courage, their contributions, their ministries and charities alleviating suffering, or their deaths at the hands of real persecution. Earlier this month, President Biden managed to issue a 492-word statement celebrating the Islamic “holy month” of Ramadan. That’s over five times more words than his statement for Easter. […] Is our “most fundamental freedom” actually to be our true selves? Is this absolute? Does that apply to pedophiles? Does that apply to racists? Does that apply to misogynists and rapists like Harvey Weinstein? The irony is that transgenderism isn’t about being one’s “true self” but one’s altered self — materially, chemically and surgically. Biden posted on X: “You are made in the image of God, and you’re worthy of respect and dignity.” Made in the image of God but, sure, go through bodily mutilation to reform yourself into your own image.

FBI Director Christopher Wray reiterated his warnings about China and the country’s cyber and physical threats toward the U.S. on Tuesday. Wray spoke before the American Bar Association in Washington, D.C. The FBI director has been ringing warning bells about China for months, both in personal statements and in congressional testimony. “Front and center is China – the defining threat of our generation,” Wray said. “To put it simply, the CCP [Chinese Communist Party] is throwing its whole government at undermining the security and economy of the rule-of-law world.”

By prioritizing crisis management in response to escalating tensions, President Biden and his national security team risk inadvertently paving the way for a war between Iran and Israel. The Sullivan doctrine, which appears to avoid taking decisive measures against Iranian aggression, heightens the possibility of a war that could lead to the first-ever use of a nuclear strike in the Middle East. Historically, Israel has been proactive in preventing its adversaries from acquiring nuclear capabilities, as evidenced by military strikes in Iraq in 1981 (Operation Opera) and Syria in 2007 (Operation Orchard). However, the challenge posed by Iran is notably different in terms of geography and strategy, complicating the application of the Begin Doctrine—Israel’s preemptive strategy to neutralize existential threats. Iran’s vast geographic expanse, covering approximately 648,195 square miles, significantly surpasses both Iraq (169,235 square miles) and Syria (71,498 square miles). This extensive area allows for the dispersion of nuclear facilities across a broad territory, thereby complicating any potential preemptive strikes. This challenge is intensified by Iran’s daunting terrain, which features significant mountain ranges such as the Elburz, Central and Eastern ranges, and the Zagros Mountains. Only Israel faces impossible standards for conducting war. Last week Israel mistakenly attacked with missiles a humanitarian convoy in Gaza, killing seven aid workers. As they have done for eight decades, Israel’s international enemies and alleged friends across the world immediately started demonizing Israel and accusing the IDF of intentionally targeting the aid workers. Biden also suggested just that when he said, “Even more tragically, this is not a standalone incident,” adding that the war in Gaza “has been one of the worst in recent memory in terms of how many aid workers have been killed.” Of course, Biden claims as well that Israel’s alleged callous indifference to the lives and well-being of civilians and aid workers “is a major reason why distributing humanitarian aid in Gaza has been so difficult—because Israel has not done enough to protect aid workers.” Sadly, such unjust reactions and mendacious slurs against Israel have been unexceptional for decades. And only Israel faces incessant criticism over the mistakes and miscalculations that are the tragic, eternal contingencies of war.

Israel has set a date for the military offensive against the remaining Hamas terror battalions in Gaza’s southernmost city of Rafah, Prime Minister Benjamin Netanyahu announced on Monday night. “It will happen; there is a date,” revealed Netanyahu, adding that he had received a “detailed report” on the high-level hostages-for-ceasefire negotiations that ended in Cairo earlier on Monday. Matthew Miller, the US State Department spokesman, told reporters on Thursday, “To my knowledge, we have not been briefed on that date.” I can’t imagine why.

The Iran regime has spent the last two years supplying terror groups and criminal gangs in the West Bank with weapons to destabilize the area, according to a report by The New York Times. Iranian officials told the newspaper that there is no specific group that the munitions are prioritized for, as the goal of the operation is to create a general breakdown in security. The article stated that Tehran is primarily using Bedouin smugglers to transport the contraband across Israel’s 300-mile border with Jordan. Unlike other neighboring countries, much of the Jewish state’s eastern boundary lacks the security measures often found in other areas.

Al-Quds Day, a kind of international Islamic Nuremberg Rally, was conceived by Ayatollah Khomeini and his gang during the Islamic Revolution, only a few months before Iranians murdered eight US servicemen and took 66 American hostages in 1979.

This squatter crisis is the result of woke Democrats’ systemic effort to normalize property theft since the Covid-19 pandemic. In April 2020, the Centers for Disease Control and Prevention (CDC) imposed an eviction ban, even though the agency lacked legal authority. The ban prevented landlords from collecting rent and evicting tenants. The CDC essentially voided the majority of rental contracts and violated landlords’ property rights with the eviction ban. The eviction ban was supposed to be a temporary measure that would expire by the end of 2020. However, after Joe Biden became president, his administration renewed the federal eviction ban three times until the U.S. Supreme Court lifted the ban at the end of August 2021. Still, the court decision failed to prevent some Democrat-controlled states and municipalities, such as Alameda County, California, from extending the eviction ban well into 2023, long after the pandemic was over.

The Arizona Supreme Court upheld a law on Tuesday that imposes imprisonment of up to five years on anyone who executes a surgical or chemical abortion in the state, except to save the life of the child’s mother. The law, first enacted in 1864, effectively outlaws abortion beginning at conception except to save the mother. […] The Arizona Supreme Court, however, found on Tuesday that “the legislature has demonstrated its consistent design to restrict elective abortion to the degree permitted by the Supremacy Clause and an unwavering intent since 1864 to proscribe elective abortions absent a federal constitutional right—precisely what it intended and accomplished.” “To date, our legislature has never affirmatively created a right to, or independently authorized, elective abortion. We defer, as we are constitutionally obligated to do, to the legislature’s judgment, which is accountable to, and thus reflects, the mutable will of our citizens,” the court’s opinion states. […] Arizona Attorney General Kris Mayes claimed she would refuse to enforce it on any “woman or doctor,” but Warner said county prosecutors could. Tuesday’s decision is a decisive victory for the pro-life movement, but the fight over abortion in Arizona isn’t over.

CNN reported Tuesday that Mercurio “planned to attack churches in Coeur d’Alene, Idaho, on Sunday ‘using weapons, including knives, firearms, and fire,’ according to court documents cited by the Justice Department.” He is accused of writing out his plan: “Stop close by the church, equip the weapon(s) and storm the temple, kill as many people as possible before they inevitably disperse/scatter, then burn the temple to the ground and flee the scene.” He planned improbably to repeat this scenario at all 21 churches in Coeur d’Alene; what he imagined the local police might be doing in all the time it would have taken to do this is unclear. […] Authorities are warning that Mercurio is an example of the “dangers of self-radicalization,” but they have not and will not, of course, say a word about the material that radicalized him.

As the Tucson Sentinel reports, terramation is currently only legal in Washington, Oregon, California, Colorado, New York, Vermont, and Nevada, however many other states are in the process of changing laws prohibiting the practice.
