Philip Hamburger is the Maurice & Hilda Friedman Professor of Law at Columbia Law School. In 2014 Hamburger published his monumental treatise Is Administrative Law Unlawful? In this post I am adapting the review I wrote for National Review. Professor Hamburger observed that although administrative law is unrecognized by the Constitution, it “has become the government’s primary mode of controlling Americans.” He further noted, however, that “administrative law has avoided much rancor because its burdens have been felt mostly by corporations.” That is changing: “Increasingly, however, administrative law has extended its reach to individuals. The entire society therefore now has opportunities to feel its hard edge.” In the name of controlling the climate, the EPA now seeks to regulate the internal combustion engine out of existence. Thus the new EPA regulations putting cars, buses, and trucks as we know them on the path of ultimate extinction. […] Hamburger argues that it is a fundamentally unconstitutional, unlawful, and illegitimate form of government. He has some impressive authority on his side. James Madison famously proclaimed “a political truth of the highest intrinsic value” in Federalist 47: “The accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny.” Hamburger concurs, arguing that it may also justly be pronounced the very definition of agency government.

A new legal analysis in the Columbia Journal of Environmental Law proposes filing lawsuits against America’s agriculture industry, following the same legal playbook climate activists are using against the oil industry. To be sure, climate activists have for years targeted the agriculture industry, particularly methane emission from cattle and their manure. The United Nations, in fact, has a program dedicated to educating people about how meat production is contributing to climate change. In addition, the Environmental Protection Agency has a white paper, updated in February, titled, “Practices to Reduce Methane Emissions from Livestock Manure.” And articles regularly appear in left-leaning media telling people that giving up meat is a way they do their part to stop what they say is a crisis. But agriculture, at least until perhaps now, has largely been a secondary target for climate activists, who have set their sights more on the carbon emission of fossil-burning power and manufacturing plants and the estimated 250 million gas-powered automobiles now on U.S. roads.

The movie backs up its claims with a diverse selection of slides and graphs which track micro and macro trends of the multivariate factors which contribute to changes in climate. Geological evidence from thousands and millions of years ago can provide a wealth of information about the history of the earth’s climate. From rock strata and ice cores, from fossils of large animals down to protozoa, we can ascertain fluctuations in the earth’s temperature, the composition of the earth’s atmosphere, and to a large degree the nature and extent of plant and animal life. The current climate science consensus contends that we are engulfed in an existential crisis for the very existence of earth as a life-sustaining planet. The evidence suggests otherwise. Because carbon dioxide, or just “carbon” in the current vernacular, occupies such an eminent position in the pantheon of climate science, it is appropriate to focus on the movie’s narrative regarding the abatement and purging of CO2:

In My Grandfather’s Son, Clarence Thomas tells the story of his contentious confirmation hearing in great detail. Back in the fall of 1991, Thomas faced unexpected charges of sexual harassment brought by liberals attempting not just to defeat him, but to destroy his reputation and perhaps to intimidate other conservatives from seeking a Supreme Court appointment. The charges were echoed in the liberal media in what amounted to an electronic lynch mob. Now the same bad actors are at it again, attacking Justice Thomas in an effort to neuter the Court and sway its rulings on former President Trump’s appeals and other matters. Not long ago, a little known Virginia politician initiated a lawsuit charging that Thomas had failed to file state taxes under the Virginia Fraud Against Taxes Act (VFATA). This is just the latest in a long history of questionable scrutiny by the Democrat-controlled Senate Finance Committee and many others. The current charges against Thomas are the result of liberal desperation and resemble what happened back in 1991. During Thomas’s confirmation hearing, Democrats on the Judiciary Committee would stop at nothing to block his appointment, ultimately bringing forth Anita Hill to accuse him of sexual impropriety. Through all of this abuse, not just from the Committee, but from the media as well, Thomas retained his composure by drawing on the strong faith that his grandfather had taught him.

Yes, you read that right: foreigners are casting ballots in American elections. It is not a myth or Bigfoot. It is happening. The number one source for alien registration is the DMV registration system. The overwhelming majority of foreigners who end up registered to vote come through the DMV. The second most prevalent is student visas. Illegal border crossers comprise a smaller percentage of aliens to get registered. Data support these conclusions. […] What can be done about aliens registering to vote? Unfortunately, as evidenced by a U.S. Senate hearing earlier this month, the Left has no problem with aliens voting. This compromise, which amounts in essence to a return to an earlier form of feminism, is untenable. Both Bachiochi and Schleuter deserve a longer treatment of their specific arguments, but I will offer here a single overall critique: the sex-realist feminists are not realistic enough about either sex or feminism. A compromise between the forces that built civilization and those that want to tear it down is impossible.

Six months later, cross-sex hormones were prescribed. The complaint also alleges that the prison failed to accommodate the inmate’s requests for “reasonable modifications” to some of its sex-based policies.These “reasonable modifications” included: transfer to the women’s cell block, requests to purchase female undergarments, clothes, and makeup, and requests to be pat searched by only female officers. These were all denied. According to the DOJ, “because UDOC failed to provide her equal access to health care services and reasonable modifications for her gender dysphoria to enable her to live consistently with her gender identity (female), Complainant’s distress over the incongruence between her gender identity and assigned sex worsened, leading her to perform self-surgery to remove her own testicles in May 2023.”

Right now things look good for Israel. But the Islamic Republic is playing the long game. And its advantages, alas, are many. Is there an ending to the Gaza war and all its complementary confrontations in which Iran and its proxies lose and Israel and the United States win? On the surface, things look good for Israel. The Israeli Defense Forces appear to be demolishing Hamas—the most important Sunni member of Iran’s mostly Shiite axis of resistance. Crushing Hamas in Gaza would be a significant accomplishment even if, as one retired Israeli general put it, the group survives and the victory gives the Jewish state only “three to eight years” of peace. But “mowing the lawn”—Israel’s periodic pummeling of its enemies in Lebanon, Syria, Gaza, and the West Bank—doesn’t eliminate the Jewish state’s foes. (Indeed, the IDF’s reliance on that tactic may have contributed to the hubris that made Israel’s vast intelligence failure of October 7 possible.) Still, Israel’s aggressive counteroffensive in Gaza has introduced more concern in Tehran and Beirut about a full-scale war between Israel and Hezbollah and the possibility that Jerusalem just might finally strike Iran’s nuclear program. Moreover, Israel’s determination to continue the war, despite the Biden administration’s increasingly aggressive pressure campaign to stop it, makes Israeli deterrence in the Middle East more credible even though the devastation in Gaza is a public-relations disaster.

The International Court of Justice (ICJ) issued its preliminary ruling in the genocide case brought by South Africa against Israel on January 26, 2024. It landed with a thud, the world shrugged its shoulders, and nothing changed. The ruling was provisional, and a final ruling on the merits may be years away. But this is not why the ICJ ruling is of marginal jurisprudential importance. A close reading reveals that the erstwhile “World Court” is now as debased as so many other United Nations agencies, such as the General Assembly and the Human Rights Council, not to mention the office of the Secretary General. Its ruling can only be described as perfunctory and mechanical, filled with faux jurisprudence that tries, but fails, to conceal the ICJ’s bias. Whatever prestige the ICJ seeks to retain through the observance of ceremonial pomp and circumstance is in tatters as a matter of fact for any serious observer of its deliberations. […] The meat of the decision resides in the ICJ’s consideration of two questions: 1) whether it had prima facie subject matter jurisdiction under Article IX of the Genocide Convention to consider whether to issue provisional measures; 2) whether the factual circumstances of the war in Gaza justified the Court’s issuance of provisional measures under Article 41 of the Statute of the Court. […] The United States was wise to opt out of Article IX, and the moral of the story is that Israel should have done so as well. We now live in a world of strange and unfortunate political ironies.
