At that point, her only path would be to be on a conservative talk show somewhere,” Romero said. After the Washington Examiner published its story on Twitter, Lake responded: “Never.”

In a Tweet detailing the plan, Greene insisted McCarthy would invoke the Holman rule, a procedural measure by which the House may adjust appropriations legislation to reduce the salary of or fire specific government employees. Cleveland: In This Untold Story Of Poll Worker Data, Chinese Servers, And Scandal, Only The FBI Knows The Truth

Developments over the last month in two cases, one criminal and one civil, involving the election-management software company Konnech and its CEO Eugene Yu, reveal the FBI remains mired in malfeasance. Either the FBI has abandoned multiple confidential human sources and discarded an 18-month investigation into evidence that Yu maintained the personal information of tens of thousands of American election workers on a server in China, or the bureau has allowed Yu to be arrested for crimes he did not commit and permitted the innocent American to be branded a felon and traitor.

While at this point the public cannot tell which scenario is true, the Department of Justice and the FBI know, and their failure either to charge Yu (or provide the L.A. district attorney’s office with confirmation of the alleged crimes) or to clear him represents another blot on the disgraced agency’s name.

Vadum: Justice Alito strongly denies accusation of leaking 2014 opinion

Supreme Court Justice Samuel Alito denied being involved in an alleged leak of a religious-freedom decision eight years ago, after a New York Times article on Nov. 19 first reported the leak and alleged that Alito may have been involved in it. The media report comes as the Supreme Court continues to investigate the unprecedented leak earlier this year of the draft majority opinion in Dobbs v. Jackson Women’s Health Organization, in which the court overturned Roe v. Wade and held that there’s no constitutional right to abortion, thereby returning the regulation of abortion to the states. The 5–4 opinion in Dobbs, written by Alito, was formally released by the court in June. Alito described the leak as a “grave betrayal.” […] The NY Times article states that the Rev. Rob L. Schenck, formerly a pro-life leader who used to run the nonprofit group Faith and Action in the Nation’s Capital, sent a letter (pdf) to Chief Justice John Roberts in July claiming he learned of the outcome of the Hobby Lobby case three weeks before it was officially handed down eight years ago. […] “Considering there may be a severe penalty to be paid by whoever is responsible for the initial leak of the recent draft opinion [in Dobbs], [I] thought this previous incident might bear some consideration by you and others involved in the process. Of course, I would be happy to fully cooperate should you find any value in other details surrounding what I have transmitted here.” The NY Times article acknowledges that “Schenck’s account of the breach has gaps,” . . .

[…] Schenck said he learned in advance of the Hobby Lobby opinion because, in the newspaper’s words, “he had worked for years to exploit the court’s permeability.” […] The Washington Post reported on Nov. 19 that the donor mentioned in Schenck’s letter was Gayle Wright. Wright said she discussed the Hobby Lobby lawsuit with Schenck but, in the media outlet’s words, “emphatically denied having spoken with Alito or his wife at dinner about the case or its outcome.” […] In the years since the Hobby Lobby decision, Schenck has moved away from his previous embrace of conservative causes.

JUDICIARY

Fyk: Federal Court Determines Section 230 ‘Is Not License To Do Whatever One Wants Online’

On Nov. 3, the Fourth Circuit Court of Appeals rendered a decision in Henderson v. Private Data that could revolutionize the internet, concluding that Section 230 of the Communications Decency Act does not immunize “all” online publication decisions. The Fourth Circuit Court just determined Section 230(c)(1) no longer protects a service provider when it acts upon third-party content (i.e., as a secondary publisher or content provider), especially if those substantive contributions are unlawful. Simply put, we have been right all along, and we now have the conflicting circuit court precedent to prove it. The Supreme Court needs to consider the Fourth Circuit’s arguments and address this split between circuits. As I’ve also discussed in Human Events and The Gateway Pundit, Section 230 has two distinct problems. Section 230(c)(1) is untenable “as applied” and it is unconstitutional “on its face.”

Durden: Judge Orders Unsealing Of Names Of 8 Anonymous Individuals Relating To Jeffrey Epstein

Judge Loretta Preska ruled on Friday to disclose the identities of a number of previously anonymous individuals in documents filed by Epstein victim Virginia Giuffre against the convicted pedophile’s associate Ghislaine Maxwell in a defamation case, according to Insider. Epstein died in jail awaiting trial while Maxwell was convicted of sex trafficking and sentenced to 20 years behind bars. Giuffre’s civil lawsuit against Maxwell has generated a trove of documents relating to Epstein, which contain a number of redacted names, some of which Preska ordered unsealed on the premise that public interest outweighs the right to privacy, according to Daily Mail.

The complaints include first-hand accounts from witnesses raising concerns regarding Maricopa’s lawful compliance with Arizona election code.

The Attorney General’s office also includes how at least 60 voting locations out of 230 in the county had tabulators and printing machines that were not working on Election Day.

2022 MIDTERM ELECTION POST MORTEM

Marshall: The GOP’s Political Consultant Problem

If there’s one thing the 2022 midterms made clear, it’s that Democrats have a huge ground game advantage over Republicans. Whether it’s a month of harvesting (and curing) ballots thanks to early voting, or going door-to-door filling out ballots for huge swaths of unlikely voters, Democrats know that turning out ballots is more important than turning out votes. They don’t have to rely on generating traditional Election Day enthusiasm through distributing campaign mailers or running TV ads. Republicans, however, still insist on investing the majority of their campaign funds into these antiquated (or pre-2020) methods. And they’re showing no signs of stopping. Why? Blame the political consultant class. For years, millions of dollars in grassroots donations have gone to prop up GOP candidates, only to end up in the pockets of the political consultant class.

Norman: The midterm results are good for Republicans, if not great

If Democrats have deluded themselves into thinking they won last week, that’s a huge opportunity for the GOP. The dust is still settling around the congressional midterms, but it looks like Republicans will retake the House by a very slim margin and Democrats will have an ever-so-slight lead in the Senate. But with stubbornly moderate Democrats such as Joe Manchin and Kyrsten Sinema, Republicans can be fairly confident the upper chamber will not try to advance the most extreme parts of President Biden’s agenda, even if they do increase their majority by one seat in the December runoff in Georgia. And of course, because of the flip in the House, those uber-progressive proposals will never make it up to the Senate. The governor’s houses in Maryland and Massachusetts may have flipped blue, but Republicans knew they were lucky to be holding them in the first place. […] But if conservatives can look past the disappointment they feel from overblown expectations, they will see there is plenty of good news. They have control in the House of Representatives and hold the majority of gubernatorial seats. In North Carolina and Ohio, Republicans won all of the Supreme Court races on the ballot, winning and preserving Republican majorities, respectively. Democratic Kansas governor Laura Kelly hung on to her job, but Republicans gained a super-majority in the House to match their existing advantage in the Senate. While Republicans lost chambers in Minnesota, Michigan and Pennsylvania, they gained a super-majority in Iowa and West Virginia and took away one held by the Democrats in Oregon. Overall a good result, if falling short of great.

Popularis: Republicans Lose Because They’re Fake Populists With No Real Policy Plans

The reason Republicans underperformed, and will keep underperforming until something changes, is that they have broadly rejected populism — which is what put Trump in the White House in 2016, not his personality. The populism on the campaign trail hit a brick wall in Washington. McConnell has bragged that he steered Trump away from the populist items Trump was elected on. So did former House Speaker Paul Ryan, R-Wis., who allegedly worked behind the scenes to slow Trump’s border wall. […] Aside from candidates like Vance, much of the populism in the Republican Party today is performative, not real. Candidates may be full of fire-breathing rhetoric, but when was the last time you heard a Republican candidate propose a plan for reforming, breaking up, or abolishing the FBI? Taking corruption out of government and reducing corporate influence? Fixing higher education? Or bringing jobs back? Populism is not being or acting like an outsider. Populism is policies that takes on protected interests and the oligarchy for the good of the many. That’s why our oligarchy hates populism. In the words of Sen. Josh Hawley, R-Mo., “what are Republicans going to do for working people?” […] Performative (fake) populism without a policy framework allows the oligarchic Democrat Party to out-populist the Republicans.

Fleetwood: How Joe Biden Used Taxpayer Money To Buy Young Voters In The 2022 Midterms

In the lead-up to the 2022 midterms, President Joe Biden had American universities use taxpayer-funded Federal Work Study programs to pay college students to engage in voter registration campaigns for the benefit of Democrats. “[O]n its face, you have to question whether this is legal or not,” Thomas Jones, president of the American Accountability Foundation, told The Federalist. “Their target audience here, college students, is overwhelmingly liberal and Democratic, so you have to question whether ‘non-partisan’ is really non-partisan.” Last April, the Biden administration told universities they are required under the Higher Education Act of 1965 to “make a good faith effort” to make mail voter registration forms “widely available” to their students. But the president’s acting assistant secretary for the Office of Postsecondary Education, Michelle Asha Cooper, went much further, claiming that as part of such efforts to increase voter registration among their students, universities may use work-study funds — which are used to provide part-time campus jobs to help students with tuition costs — to pay students to “support voter registration activities.” Having taxpayers fund get-out-the-vote activities that support Democrats in this way had previously not been allowed.

Former Vice President Mike Pence now claims Donald Trump’s “reckless” words on January 6, 2021 “endangered” Pence and his family. Some observers found Pence’s words surprising, but this is not a new trajectory for the Indiana Republican, an outspoken Christian. Back in August, Pence proclaimed “these attacks on the FBI must stop,” but the words of the former vice president should not be interpreted literally. Nobody is “attacking” the J. Edgar Hoover Building in the style of Antifa rioters in 2020, breaking windows, or launching firebombs. Neither is any investigatory body conducting sudden searches of the building and FBI archives. […] A man with a keen sense of biblical morality, Americans might think, would be pressing the FBI for what it knows about the murder of Department of Homeland Security whistleblower Philip Haney in early 2020. The FBI has Haney’s laptop, thumb drives and other materials, yet hasn’t revealed what they contain. Consider also the case of Seth Rich. In 2016 . . . […] Instead of pressuring the FBI to solve the murder and release the material, devout Christian Mike Pence attacks critics of the FBI. Instead of moral advocacy for victims of FBI stagecraft and lawlessness, Mike Pence targets Donald Trump and casts himself as a victim. Steve Bannon has called Mike Pence a “mindless, gutless symp,” but that might not cover it. The Indiana Republican brings to mind . . .

A tale of two parades in a small Texas town illustrates why conservatives can’t hide from the left. Not anymore. One of the comforting fictions conservatives are increasingly tempted to tell themselves is that if they just move to a red state or county, the insanity of the woke left won’t affect them and their family. […] Griffin himself became massively wealthy – an estimated net worth of $22 billion – through his investment firm Citadel. A report this year revealed that in 2006, Citadel “loaned $110 million to China Security & Surveillance Technology. The company used the funds to acquire ‘10 of the 50 biggest surveillance companies in China.’”

Once the Americans check their paperwork, they legally admit intending illegal border crossers like Nicaraguan Maria Esperanza Diaz Ruiz, 42, into the U.S. interior under a questionable authority known as “humanitarian or significant public benefit parole.” […] Teams of Mexicali city administrators work feverishly to enter each chosen immigrant into the CBP-ONE data portal so the Americans can pre-approve them for handoff at the Calexico border crossing. After a couple of hours, a Mexican immigration van finally pulled up to the front. A white-uniformed federal officer swung open the van door as the 25 men, women, and children piled in with a few belongings. The bus transported them into a gated section of the port of entry, where they were to be handed over to Americans for processing. CIS was not allowed to follow beyond the gated area. Indeed, thousands are hearing about this new legal way in – and swamping an expanding system of Mexican shelters that gradually feed their occupants through American ports of entry with temporary legal status and opportunity to make the big move permanent. Local authorities are working to expand shelter facilities and establish new ones to accommodate the soaring demand for the legalized crossings, two shelter managers in Mexicali and one in Tijuana told CIS. Mexicali city officials recently granted CIS rare, unfettered access to their side of the legalized border-crossing operation that began in September with President Biden’s Department of Homeland Security. Construction on a significant building expansion was underway on acreage behind it. […] The system benefits open-borders advocates and the Biden administration too, pleasing immigration doves in the Democratic Party who demand unimpeded cross-border travel and an end to immigration enforcement. But mainly, the numbers of legal hand-off crossings don’t add to the politically problematic apprehension statistics that worry some Democrats. After all, technically, this could no longer be called “illegal immigration” if it’s been made “legal.” And, even better for politicians and for hopeful migrants heading north, this kind of entry happens out of sight of news cameras, and therefore remains out of the public mind.

This is not hyperbole or exaggeration. Godwin’s Law holds that if you invoke Hitler or compare some contemporary figure to Hitler, then you lose. That’s all very well, unless you’re talking about real fascists. Joe Biden is a real fascist. The Democrat Party is at this point a fascist party. Biden, on the other hand, has called conservatives fascists, and Trump in particular. But what exactly is a fascist? […] What Biden was saying was very clear: we have the military behind us, and we are going to come after you. We are going to make what you were saying and doing a criminal act. We are going to rule you out of the political life of the United States of America. What Joe Biden was doing was a quintessentially fascist act. He has all the corporations and all the media, as well as all the industries behind him. They all work for the same point of view, and now he is moving to eliminate the opposition. So when we look at the election of 2022, it’s very clear what happened. Shurk: Ctrl+Alt+Delete the Totalitarian State

There are three government narratives pushed today that are not real: (1) fraud-free elections, (2) a looming climate apocalypse, and (3) a COVID health emergency requiring total government control. If you see through only one, then you’re not looking hard enough. Or as Bill Engvall might say, “If you now believe COVID is mostly a hoax but are still terrified of global warming, here’s your sign.” Conversely, if you do see through them, you’re likely being censored for expressing those points of view. Here’s our impasse: when governments claim to have a monopoly on truth, then citizens are expected to accept preposterous fantasies, no matter how much opposing evidence they might see. The narrative is absolute. Dissent is forbidden. Total obedience is the objective. Last century, free Westerners understood these features as telltale signs of totalitarianism. Today, much less free Westerners have been taught to embrace — without scrutiny or wisdom — the government’s fairy tales as part of our required, if not sacred, deference to the bureaucratic State’s cult of expertise. Whether citizens grasp this shift in individual freedom or not, the general rule handed down from governments is stark yet succinct: ask us no questions, and we will tell you no lies! Westerners desperately need to reboot their systems of government before those systems of government delete the public’s power to make changes ever again. It is not possible for political leaders to claim that their countries support personal freedom when they snatch that freedom away at the first sneeze, cow fart, or unapproved tweet. It is not logical for governments to claim that they protect “democracy” when armies of unelected permanent bureaucrats run the modern State. It is not reasonable for Western nations to claim that they cherish “free thinking” and “free expression” when their technocratic surveillance arms actively censor speech and promote State-approved points of view over all others. Notice that the above paragraph makes sense only if you have not already become so brainwashed by State “narratives” as to think active government control over an individual’s body and mind nonetheless advances human liberty, democracy, and free speech.

New rules from the Biden administration will worsen gender-related distress in children. In July, the Department of Education’s Office for Civil Rights (OCR) published a 190-page proposal for new rules under Title IX of the Education Amendments of 1972. If passed, the rules would reintroduce Obama-era standards for defining and addressing “sexual harassment,” which means, in practice, restrictive speech codes, proliferating Title IX jobs on the public dime, and campus kangaroo courts. This time, the OCR intends to add a mandatory reporting requirement that would turn teachers and professors into enforcers of an infantilizing sex bureaucracy. The most troubling aspect of the new rules, however, is what they do on the gender-identity front. Catherine Lhamon, whom Biden reappointed to the role of assistant secretary for civil rights at the Department of Education, in which role she heads the OCR, is considered a crusader on gender issues. The OCR intends to ramp up the pressure on school districts to adopt policies that will facilitate students’ gender transitions, even without the knowledge or consent of their parents. This marks a disturbing twist in the continuing saga of Title IX expansion, especially considering how the new policy is likely to harm girls disproportionately. Under the political cover of “civil rights,” the Biden administration is cementing the school-to-clinic pipeline.

Pearson: Lawsuit Claims Massachusetts and Google Installed COVID-19 Spyware on 1 Million Devices

The Massachusetts Department of Public Health (DPH) is facing a class action lawsuit for allegedly working with Google to install “spyware” onto the Android devices of a million state residents without their knowledge during the COVID-19 pandemic. Plaintiffs Robert Wright and Johnny Kula were among 1 million Massachusetts residents who had the state’s “COVID Exposure Settings: US-MA” app auto-installed without their consent, according to the New Civil Liberties Alliance (NCLA), the nonpartisan civil rights group that filed the lawsuit (pdf) on Tuesday. The app, once automatically installed, didn’t appear on the device’s home screen as newly-installed apps typically do. Instead, it was invisible and could only be found by opening “settings” and using the “view all apps” feature, according to NCLA.

Stieber: FDA Says Telling People Not to Take Ivermectin for COVID-19 Was Just a Recommendation

The U.S. Food and Drug Administration (FDA) telling people to “stop” taking ivermectin for COVID-19 was informal and just a recommendation, government lawyers argued during a recent hearing. “The cited statements were not directives. They were not mandatory. They were recommendations. They said what parties should do. They said, for example, why you should not take ivermectin to treat COVID-19. They did not say you may not do it, you must not do it. They did not say it’s prohibited or it’s unlawful. They also did not say that doctors may not prescribe ivermectin,” Isaac Belfer, one of the lawyers, told the court during the Nov. 1 hearing in federal court in Texas. “They use informal language, that is true,” he also said, adding that, “it’s conversational but not mandatory.” The hearing was held in a case brought by three doctors who say the FDA illegally interfered with their ability to prescribe medicine to their patients when it issued statements on ivermectin, an anti-parasitic that has shown positive results in some trials against COVID-19. […] “If the government is going to label ivermectin a horse medicine or a horse dewormer and promulgate the idea that it is only for animals, then the natural correlation is that doctors who prescribe it are horse doctors or quack doctors, which has played out,” he said. “That is enough of a harm to get into court,” or have the motion to dismiss rejected, he said. Ivermectin is used on animals in addition to humans. The FDA used a picture of a horse in its Twitter posts and on one of its pages.

“The government engaged in a singularly effective campaign here to malign a common drug that has been used for a very long time and has been dispensed in billions of doses. It’s one of the most famously safe drugs in the history of human medicine. And when people did exactly what the FDA said to ‘Stop it. Stop it with the ivermectin,’ I don’t understand how that would not be traceable back to the FDA,” Kelson said.
