In the upcoming case Moore v. Harper, the U.S. Supreme Court will decide whether the term “state legislature” in the U.S. Constitution’s election clause gives state legislatures specific power over election law that cannot be taken away in accordance with the doctrine of “independent state legislature theory.”

In this case, the Supreme Court is asked to decide whether the independent state legislature theory applies to the Constitution’s election clause. The case asks the court to decide whether a state’s judicial branch may nullify the regulations governing the “Manner of holding Elections for Senators and Representatives … prescribed … by the Legislature thereof” and replace them with regulations of the state courts’ own devising. The Constitution’s election clause reads, “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof.” […] Leftist women’s groups have responded by launching a hyperbolic campaign against the doctrine. League of Women Voters’ CEO Virginia Kase Solomón claims, “The Independent State Legislature Theory is a dangerous, fringe ideology that leaves voters effectively defenseless from harmful election laws.”

Secretary of State Katie Hobbs should have recused herself due to her running for governor in this election but her conflict of interest was ignored. The same people involved in the uncertifiable 2020 Election were also involved in this election. They too should have been removed. The systems are the same systems with still unanswered questions from the 2020 Election. As a result a group of citizens in Arizona released a statement last night calling for a new election. They request that this election in the state be held on December 6.

Mittelstadt: Possible recounts loom in Arizona as machine issues marred Election Day

The elections for Arizona attorney general and superintendent of public instruction have yet to be decided, with nearly 2.5 million votes counted, which is estimated to be more than 95% of the total vote. As of Tuesday night, GOP attorney general candidate Abraham Hamadeh was trailing Democrat nominee Kris Mayes by 771 votes, according to the unofficial results reported by the Arizona secretary of state’s office. The percentages of each candidate was 50.0%. In the superintendent race, Republican nominee Tom Horne led Democratic incumbent Kathy Hoffman by 8,576 votes, which is 0.4% of the vote.

Recounts cannot be requested by candidates or members of the public, but rather are triggered if there is less than or equal to half of 1% of the total number of votes between the top two candidates, which is five times greater than the previous threshold of 0.1%, explains the secretary of state’s website. The change occurred after a new law took effect this year, following President Biden’s 0.3% margin of victory over former President Trump in the 2020 election.

Election judge Michele Swinick has come forward to report what she experienced in Maricopa County on Election Day. She worked Election Day as a judge at the Islamic Voting Center in Scottsdale, AZ. She reports that the center is heavily Republican, with “no party” designated voters as the second most populous demographic, followed by very few democrat voters, evidenced by the fact that she checked in very few of them on Election Day. She reports she spent the entire day checking in voters. Swinick says that the tabulators all worked “perfectly” during the test the night before the election. The problem with scanning began immediately with the first ballots. Voters scanned their ballots between 4 and 12 times with very minimal success. Poll workers estimated about 1 in 10 ballots were being read for the first three hours of voting. […] “In my opinion, the machines were programmed to do this, and it was all planned. Greenfield: Arizona’s Elections Will Be Much Worse Next Time Around

Adrian Fontes, Maricopa County Recorder from 2016 to 2020, has beat out Mark Finchem in the race for Secretary of State, the Associated Press reports. Fontes served as County Recorder amid claims of fraud in the 2020 election. He ran for re-election but loss to Republican Stephen Richer. In addition the 2020 controversy, Fontes also faced a lawsuit over signature verification in 2018 when he had to open emergency voting centers after a contractor delayed the opening of some polling places.

The race for the Hillsborough County House District 16 seat in Manchester, saw Democrat Maxine Mosley defeat her Republican opponent Larry Gagne by a single vote. Mosley won the seat with 1,799 votes to Gagne’s 1,798. Before the recount, Gagne led Mosley by 23 votes.[…] “Wow! Democrats erased a 23-vote deficit in a recount to win this NH House seat by ONE vote,” he tweeted. “They need to do the same in 3 more seats to win a majority.”

Solomon: Texas governor declares invasion at border, invokes constitutional powers in historic action

Abbott’s decision came after three dozen counties in his state passed resolutions calling for the dramatic action. The Republican governor said the declaration allows him to send National Guard troops to the border, treat drug cartels as terrorist organization and to build his own border wall separate of the federal government, “I invoked the Invasion Clauses of the U.S. & Texas Constitutions to fully authorize Texas to take unprecedented measures to defend our state against an invasion,” Abbott tweeted in his announcement. “I’m using that constitutional authority, & other authorization & Executive Orders to keep our state & country safe.”

Singh: Warnock, DSCC Sue To Allow For Extra Day Of Early Voting In Georgia Senate Runoff

Warnock, joined by the Democratic Party of Georgia and the Democratic Senatorial Campaign Committee, has filed a complaint for an injunction in the Fulton County Superior Court, seeking to force Georgia to allow early voting on Saturday, Nov. 26. Early voting in the race is scheduled to begin on Monday, Nov. 28 and run until Friday, Nov. 29, the mandatory five days required by state law. Georgia elections law prohibits early voting on a Saturday if a holiday falls within two days of it.

Greenfield: Only Nixon Could Go To China, Only Biden Could Bow to China

They said that only Nixon could go to China, but only Joe Biden could bow to China. And bow so low that he could have tied his shoelaces with his teeth. Biden, who usually needs a nap and calls a lid after eating ice cream, spent over three hours meeting with Chinese President Xi Jinping who, hopefully if the meeting went well, offered Hunter Biden a job. During their joint opening remarks, a reporter asked if Biden would press Xi about China’s lack of human rights. A Chinese Communist thug quickly pulled her back and then pushed her to the door.

Biden said nothing while an American reporter was attacked in front of him.

“Why are we not talking about fentanyl — the chemical precursors that go from China to Mexico — the number one killer of young people? Why aren’t we talking about the origins of COVID-19?” Ortagus asked. “Are we just going to let them get away with this?” The White House claimed Biden “raised concerns about PRC practices in Xinjiang, Tibet, and Hong Kong, and human rights more broadly.” But as Andrew Thornebrooke noted at The Epoch Times, “the Chinese Communist Party’s readout of the meeting did not mention any discussion of human rights.” Biden wants to define the U.S. relationship with China in purely economic terms, rather than a strategic competition for control of the future. As Brandon Weichet notes, “In Biden, Beijing has a president who has spent his entire career championing closer U.S. ties with the CCP.” As the record shows, that is hardly a stretch.

Schweizer: TikTok Time Is Running Out

At a time when an invasion of Taiwan by Communist China looms ever larger, why worry about TikTok? Targeted at American teens, TikTok is a mobile app for sharing short videos, owned by a Chinese company called ByteDance. After five short years on the market, it has more than one billion users worldwide. The app has lived under deep suspicion for much of that time, as American cyber-security and counter-intelligence experts have warned about its enormous reach and direct connections to the Chinese Communist Party. During the administration of President Donald Trump, the White House considered an outright ban on the app. Senators as diverse as Charles Schumer (D-NY) and Josh Hawley (R-AR) led the charge to ban it or force its parent company to sell it. Nothing ever came of that push, and sale negotiations between ByteDance and both Microsoft and Oracle failed to reach a deal. The only concession made was that today, internet traffic to and from TikTok in the US supposedly flows only through servers owned by Oracle, which is paid by ByteDance to manage the app within the US. Crucially, though, parent company ByteDance will not say whether data collected through the app ever passes through Chinese hands and to the Chinese government. While it has a US office, its employees frequently work on Beijing time and answer to executives back in China. A Forbes review of LinkedIn profiles for TikTok and ByteDance employees revealed that 300 of them worked previously for Chinese state media, or still do.

On November 4, 2022, the Republican staff of the House Judiciary Committee published a report based primarily on whistleblower testimony, describing how the FBI and the Justice Department have become politically weaponized against conservatives. I strongly urge every AT reader to download the report and spend 30 to 60 minutes reading the first 50 pages. Here are a few of the salient points. The Washington Field Office is manipulating its case filing system to feign a nationwide rise in domestic terrorism. The geography of where a crime is committed ordinarily determines who will open an FBI file. For example, if a crime is committed in Dallas, the FBI’s Dallas Field Office will open the file and conduct the primary investigation. However, this is not the case with the January 6 arrestees. Under orders from Director Wray, files have been opened in the geography where the defendant resides, but the Washington Field Office (WFO) is in charge of the investigation. This gives the false impression that domestic violence extremism (DVE) cases are much more geographically spread around the country than they actually are.The FBI downplayed and sought to reduce the spread of the serious allegations of wrongdoing leveled against Hunter Biden . . .

In a sign of a potential shift in the mainstream media’s coverage of the issue, NBC News has published a report acknowledging a possible link between COVID-19 vaccines and myocarditis. NBC’s November 12 report opens with an anecdote about Detroit resident Da’Vion Miller, who at age 22 passed out at his home and was later hospitalized and diagnosed with myocarditis and pericarditis one week after receiving his first dose of Pfizer’s mRNA-based COVID shot and was subsequently advised by doctors not to receive his second.

In “My troubling COVID vaccine story experiences,” I wrote last year about how within a short period of time I met three men at the same recreational area who announced to me they’d had heart attacks. All three had previously taken the coronavirus genetic-therapy agents (GTAs, AKA “vaccines”). Add the friend who suffered heart inflammation and the neighbor of mine who had an adverse reaction after having the shots, and it was quite a series of “anomalies.” I’ve had another similar experience now, too. In an opinion piece for Scientific American, writer Bryn Nelson insinuated that my factual reporting on Drag Queen Story Hour was an example of “stochastic terrorism,” which he defines as “ideologically driven hate speech” that increases the likelihood of unpredictable acts of violence. […] This is a bizarre claim that, for a magazine supposedly dedicated to “science,” hardly meets a scientific standard of cause and effect. There is no evidence that DePape watched or was motivated by Tucker Carlson’s program; moreover, nothing in my reporting on Drag Queen Story Hour encourages violence or mentions Nancy Pelosi, QAnon, or Satan-worshipping pedophiles. […] The scheme works like this: . . . […] If this process is left unchecked, the consequences will be disastrous. A new study from the Hebrew University of Jerusalem found that sperm concentration has fallen drastically among men worldwide since the 1970s, and the drop is accelerating. The study published in the Human Reproduction Update built on data from a study published five years ago that gathered information on sperm concentration in men from Western countries, The Guardian reported. The newest study looked at data from 57,000 men in 53 countries around the world, finding that sperm concentration dropped 51% between 1973 and 2018, from 101.2m per ml to 49.0m per ml.

Winter: How Conservative Men Can Help Solve The GOP’s Single Women Problem

Last week’s election revealed an ever-deepening divide between the voting preferences of single women and everyone else. Single women broke +37 for Democrats, whereas single men, married men, and married women all favored Republicans. Perhaps “toxic feminism” or “AWFL discourse” is the problem. But whatever the explanation, given the slim margins of the recent election, this is a real issue for Republicans. Such voting trends are problematic yet understandable. Single women who lack the protection and security that a husband or father provides are likely to look elsewhere, such as to government, for the securing of their interests. Increasingly atomized and isolated from family and community, it is understandable that many single women vote for politicians who will help shape society to be more amenable to their natural instincts.

Winning the hearts and minds of society is arguably easier to achieve by promising hand-outs. Also, especially in the age of rapid communication, emotion sells — a handy method for sneaking political takeovers through the back door. So, when it comes to something as fraught with emotion as medicine, it is difficult to argue the downsides for fear of appearing heartless. This may be a least one reason that socialists seem to think they have the monopoly on altruism. Claiming that conservatives are less compassionate because many basic needs are not offered for free can miss the point. Too often what is offered are words; what is actually ends up being delivered may be sorely lacking — as disillusioned citizens in places such as Venezuela and Cuba have found out the hard way. However, this type of Santa-Clausian virtue-signalling — of providing everything for everyone for free — can be an effective strategy not only to get votes but also to protect the welfare system from the overhaul it so desperately needs but will never get. […] Over time, as governments began to separate themselves from religion, many responsibilities of the church became transferred to the state. The gradual progression of socialist and Marxist thought, meanwhile, further increased the divide, while at the same time expanding the remit of governmental reach into people’s daily lives. Ever since being rolled out universally in 1945 (1938 in the U.S.), the UK’s welfare system, as it has sought to keep up with its burgeoning population, has kept expanding. Now, however, immigration, changes in the workplace, a massive increase in disability payments (along with what constitutes “disability”), the length of time people remain unemployed and an increasingly bloated bureaucracy have all contributed to breaking the back of an outdated system.

The median policy preference of the Democratic Party base—including on U.S. foreign relations—is an excellent guide to whatever Biden happens to believe on any given day. Not one of Biden’s presidential appointees was held accountable. That sent a signal to every would-be predator in the global arena that Joe Biden was a soft touch. Vladimir Putin, looking to take advantage, followed with a full-blown invasion of Ukraine. Biden failed to deter that assault. The White House then realized that serial weakness on national security policy might be a problem in more ways than one. […] Cotton’s central, eye-opening insight in this book is that progressives deliberately hamper U.S. freedom of action in world affairs because they do not trust it. Nor do they really trust the American people, including on foreign policy, whenever the outcomes diverge from left-wing preferences. Instead, progressives trust transnational networks of administrative, legal, and academic experts to promote and implement desirable policies over the heads of elected officials. We know this because they say so. The resulting challenges to American sovereignty are real.
