Ron DeSantis is building out a national donor network. Former Vice President Mike Pence is giving speeches about his vision for the GOP. Sen. Tom Cotton (R-Ark.) moved a key aide to his political operation. Virginia Gov. Glenn Youngkin campaigned in Arizona, Nevada, and Michigan. And Sen. Tim Scott (R-S.C.), Nikki Haley, and others have made visits to critical early voting states of Iowa and New Hampshire. After Roe v. Wade, the constitutional case that bothered me most my first year of law school was probably Wickard v. Filburn. The case is disturbing both for its blatant distortion of the Commerce Clause and for the precedent of federal overreach it created. Now that Roe has fallen and we have a U.S. Supreme Court clearly willing to overrule bad precedent, any good conservative should hope, pray, and work to see Wickard v. Filburn overruled. Filburn was the owner and operator of a small farm in Ohio. Under the Agricultural Adjustment Act of 1938, the federal government attempted to control the price of wheat by allotting how many acres of wheat a farmer could grow in that particular year. Filburn grew and threshed more wheat than was allotted, and then refused to pay the federal penalty. The intended purpose of this law was “to control the volume [of wheat] moving in interstate and foreign commerce in order to avoid surpluses and shortages and the consequent abnormally low or high wheat prices and obstructions to commerce.” That is a fine intention. But the federal government has limited enumerated powers; . . .

The Supreme Court will soon consider Students for Fair Admissions v. Harvard/UNC. The court’s decision will determine whether our military’s future leadership will consist of the “best-qualified” individuals instead of simply those “qualified” as defined by an ever-moving standard meant to accommodate political and cultural goals. Affirmative action, in the form of racial preferences, pervades today’s military despite federal law that, if enforced, would prevent it. Section 601 of the Civil Rights Act of 1964 prohibits racial “discrimination under any program or activity receiving Federal financial assistance.” Racial preferences in the military also violate our Constitution’s Fifth Amendment Due Process Clause. Department of Defense (DOD) surrogates speciously have argued to the Supreme Court that the DOD’s use of racial preferences in service academy admissions is “mission critical” and “indispensable to” national security. That strategy was contrived only because of the legal framework courts must use when examining practices that violate the Constitution. Evidence must clearly prove a “compelling state interest” sufficiently strong to justify the drastic measure of suspending the constitutional provision that prohibits such practices.

Thoroughgood: Court Rules on Rights of Christian Baker in Same-Sex Wedding Case

Miller was exonerated on charges that followed her religious objection to creating a wedding cake for a same-sex couple, Eileen and Mireya Rodriguez-Del Rio, due to her Christian beliefs. Judge J. Eric Bradshaw of the Superior Court of California ruled, “The evidence affirmatively showed that Miller’s only intent, her only motivation, was fidelity to her sincere Christian beliefs.”

Lupo: Richmond County Supreme Court Judge Ends New York City’s Vaccine Mandate for State Employees, City Appeals Using Tax-Payer Funds

A Judge for the Richmond County Supreme Court, Judge Ralph Porzio, has ruled that the vaccine mandates issued by the New York City Health Commissioner are unconstitutional and violate the separation of powers. The order permits city employees to return to work effective today. According to attorney Chad Laveglia, the judge ruled “the commissioner’s order mandating private and public employees get vaccinated was arbitrary and capricious.” While Laveglia was representing members of the Dept. of Sanitation in New York (DSNY), this ruling will impact the FDNY, NYPD, Dept. of Corrections and all other city employees who were shut down and forced to resign for refusing to cave in to an experimental emergency use vaccine.

While the definition of death is being fiercely debated in the medical literature, the public has been kept in the dark. Or is the public being intentionally misled? As bioethicist David Rodriguez-Arias writes, “[t]he history of death determination in the context of organ donation can be described as an indoctrinating attempt to settle a moral controversy.” […] Death occurs when the spirit departs from the body, causing the body to lose the complex integration of all its systems, leading to the disintegration of those systems. In biological terms, death is the loss of integration of the organism as a whole. At death, the body stops maintaining itself with heart rate, breathing, blood pressure, temperature control, digestion, and waste management and becomes a corpse. This definition of death prevailed until 1968, when the ad hoc committee of Harvard Medical School redefined death to include people in an “irreversible coma” as dead. They did this by decree; . . . […] In 1981, the ad hoc committee’s findings were signed into law as the Uniform Determination of Death Act. This act, known as the UDDA, allowed people with beating hearts to be declared legally dead and taken for organ-harvesting while still biologically alive.

Hubbard: Justice Department says Chinese agents attempted to bribe US official to thwart investigation

“The government of China sought to interfere with the rights and freedoms of individuals in the United States and to undermine our judicial system that protects those rights,” Garland said. “They did not succeed.” Ten of the 13 people charged are suspected Chinese government agents. Two people were arrested. Prosecutors allege that two suspected Chinese intelligence officials attempted to bribe a U.S. law enforcement officer to be a double agent to help a Chinese telecommunications company avoid criminal penalties.

This morning Alex Mercouris featured a fascinating summary of the recent spate of actual communication between Russia and the collective West. For at least four months there had been no contacts that we know of, then—call after call, and all at the same time that the topic of a false flag nuclear event in Ukraine was also in the news, based on Russian accusations. Also in the news at that time was word of a severed cable near the Shetland Islands, and only a bit later did we learn that a Russian ship had been in the immediate vicinity. It followed on Zelensky’s demand that, if Russia should use a “nuclear weapon” of any sort, then the West should launch a “preemptive strike” against Russia. As Mercouris pointed out, although a “dirty bomb” isn’t exactly a nuke, it is something like a “nuclear weapon”. Mercouris also pointed out the curious series of events that set all this off. […] After this flurry of communications between the Kremlin and the collective West, the collective West formally denied everything. Kind of. But Shoigu says Russia has “double verified” the evidence. It sounds like they have the goods on the collective West plotting a nuclear event. I don’t know about you, but I sure as sh*t didn’t vote for nuclear war.

History provides a model for galvanizing public attention for political action. The Naval Act of 1938 is one such example. A new version of the act could put naval shipbuilding on course to deliver the Navy the nation needs, expand the necessary industrial capacity, and do it all economically using good business practices. Arguably the nation has the resources needed to do this and needs only a reprioritization of where limited dollars are spent. Sadly, despite the dangers of the day, conventional government resourcing of the Navy has not delivered. A new naval act is needed.

Phillips: US Has Only 25 Days of Diesel Supply; Shortage Could Cripple Economy

Data provided by the Energy Information Administration (EIA) show that diesel stockpiles are at their lowest level for October in records that date back to 1993, according to a Bloomberg News analysis. EIA data show that the United States, as of Oct. 14, has 25.4 days of supply—down from 34.2 days of supply four weeks prior. National Economic Council Director Brian Deese, a top adviser to President Joe Biden, told Bloomberg News last week that current diesel levels are “unacceptably” low and that “all options are on the table” to increase supplies. The diesel crunch comes just over two weeks before the November 2022 midterm elections and will likely drive up prices even more. Diesel is the fuel used by freight trains and commonly used by long-haul truckers to transport goods and food. […] “Now, after draining our emergency reserves to a 40-year low, Democrats want billions more of taxpayer dollars to refill the [Strategic Petroleum Reserve] at more than double the price,” Sen. John Barrasso (R-Wyo.) told the New York Post last week. “This is a direct attack on every single American struggling to fill their tanks and heat their homes.”

The White House amplified multiple grocery stores and pharmacy chains’ offers to provide $20 vouchers for Americans who get another dose of the COVID-19 vaccine. Officials are encouraging Americans to receive boosters before embarking upon holiday travel over the next two months. The White House said in a statement that President Joe Biden has called upon pharmacies to “double down” on efforts to increase vaccination rates, prompting the organizations to send “tens of millions of texts, calls, and emails to customers, multimedia marketing campaigns,” while federal pharmacy partners are extending hours and accepting walk-in appointments.

The state’s Senate Majority Leadership Team, via an email press release, pointed to HB 2086, a now-signed law, that “clearly and explicitly states that COVID-19 vaccinations cannot be a requirement for school attendance in Arizona.” […] “This is just another example of how out of touch the federal government and its agencies are with everyday families. With Republicans currently in control of our state government, we can promise that we will never subject Arizonans to the requirement of an experimental vaccine that has raised questions over long-term health implications,” Republican Senate President Karen Fann said of the ACIP vote.

Attorneys General in Missouri and Louisiana have compiled several pieces of evidence that they say shows Dr. Anthony Fauci worked directly with Big Tech companies to steer public discussion about COVID-19 and shut down talk about its origin, work that includes direct conversations with Facebook CEO Mark Zuckerberg. On Friday, a federal judge ruled that Louisiana Attorney General Jeff Landry and Missouri Attorney General Eric Schmitt will get a chance to depose Fauci and other Biden administration officials on these collaborations as their case proceeds. One key fact they want to prove is that Fauci worked with Facebook and others to tamp down talk that the virus originated in a lab in Wuhan, China.

Harper: COVID-era school shutdowns caused historic learning losses for kids, DOE report shows

The Education Department released its “National Report Card,” which showed the “largest score declines” since the federal government began tracking these metrics in 1990. Math took the hardest hit, but reading scores did not fare well either. For perspective, fourth grade math scores had progressively increased by 28 points since 1990, but then dipped 5 points since 2019, taking scores back to the early 2000s levels. For eighth graders, math scores . . . […] The decline was largely nationwide, with not a single state seeing its math scores improve since 2019, though a few states were able to hold the line and fend off a large score decrease. […] The national average reading scores, which have not seen the same progressive improvement since the early 1990s, decreased by 3 points nationally compared to 2019 for both fourth and eighth grade.

Although Martin attacked the much smaller Zimmerman without provocation, and eyewitness evidence supported Zimmerman’s claims of self-defense, the media and the woke mobs frightened state prosecutors into charging Zimmerman with second-degree murder and ruining his life. Santi’s shooter, by contrast, faces no consequences whatsoever, not even a review before a grand jury. According to the Kansas City Star, Jackson County prosecutor Jean Peters Baker, a liberal Democrat known for her racially sensitive leniency, “decided not to move forward with a second degree murder charge against the woman because it could not prove beyond a reasonable doubt that she was acting outside of Missouri’s self-defense law.” […] Although admittedly not an attorney, I think a good case could be made that Santi’s shooting involved neither self-defense nor stand your ground. I think an excellent case, however, could be made that the critical variables were the same as they were in the Zimmerman case: race and politics.

NHS Makes a Shocking Admission: ‘In Many Cases,’ Gender Dysphoria Disappears as Children Reach Puberty

While not eliminating transgender treatment for children, England’s National Health Service is at least tightening the rules regarding medical and social gender transitioning. The NHS is issuing new rules when it comes to the transgender process. The new guidelines focus on emotional health over a medical approach, place doctors in charge, and even state that gender dysphoria is often just a phase of life.
