Bovard: By Bridling Section 230, SCOTUS Can Finally Do What Congress Won’t: Rein In Big Tech

The Supreme Court announced this week that it will finally attempt to do what Congress has not: bring clarity to Section 230, the law that protects internet platforms from liability for content published by others. While Section 230 operates across the internet, it is also, for Big Tech, a valuable financial subsidy.

Over nearly 30 years since its passage, lower courts have stretched what the plain text suggests is a limited, fairly porous liability into a bulletproof one, which immunizes platforms for far more than just the messages they deliver. Product liability claims for child sex crimes committed using Instagram fall under Section 230 immunity, as do all manner of the platforms’ own moderation — that is, what they do to the content posted by users. The question before the court — and, indeed, the one currently bedeviling policymakers — is how far Section 230 immunity ultimately goes.

We live, allegedly, in a democracy of sorts. While it is not a plebiscitary democracy, in which every issue is put directly to the people, but rather a representative democracy, it is nonetheless supposed to be a system in which things that the populace wants generally get done, and in which things that the populace doesn’t want done aren’t. It has probably not escaped your notice that this is not a particularly accurate description of our society today. In fact, one of the most striking things today is the extent to which things that are popular with the political class, but unpopular with the mass of voters, somehow become national priorities nonetheless. By large margins voters in America (and pretty much every other country) are opposed to mass immigration; elites, on the other hand, are very much in favor. Likewise, affirmative action, whether in employment, judicial appointments, or college admissions, is very unpopular, and yet it is the norm today, though sometimes thinly disguised. And, of course, the trans-rights movement, thanks to which female athletes have to compete against biological males, has been very much a top-down phenomenon, not one that arose because the masses demanded it. Well, the masses are not always right, though I would have thought that the point of our system of government was to ensure, within constitutional limits, that they generally get what they want and are spared things they dislike. As noted, that’s not the case. But why?

The field of artificial intelligence has seen tremendous advances in 2022 that will enable electric machines to think more deeply, feel physical pain, possibly even dream of A.I. rights and citizenship. Technology ethics will, as a result, become an issue with vast political repercussions. In 2018 already, Saudi Arabia granted citizenship to Sophia the robot. Many observers failed to take Sophia seriously, for, although the robot was impressive, it risibly answered, “OK. I will destroy humans” when asked, “Do you want to destroy humans?” […] Because the Saudis have awarded citizenship to a robot, Japan has granted residence to a chatbot, and the “European Parliament [has] proposed granting AI agents ‘personhood’ status” with “rights and responsibilities,” the matter of A.I. citizenship will inevitably have to be decided in America. In a free republic, human beings are propertied citizens, and all rights are property rights, so, this raises the question: might A.I., itself property, be given property rights? Human beings own their words and ideas, and also own their bodies and lives; ergo, the First and Second Amendments of the U.S. Constitution allow people to control and defend their words and ideas, as well as their bodies and lives. But should robots be allowed such rights of citizenship? Or should it be forbidden for a robot to injure a human being, by word or deed, for any reason?

The six leading tech firms — including Agility Robotics, ANYbotics, Clearpath Robotics, Open Robotics and Unitree — say advanced robots could result in huge benefits in our work and home lives but that they may also be used for nefarious purposes. Today, October 5, 2022, that event of more than a year ago culminated in a visit from the FBI to at least one of the activist’s homes. Other individuals, who either participated or were merely present at the facility that day, were ordered to report to their local authorities to be charged under the federal FACE (Freedom of Access to Clinic Entrances) Act along with charges of conspiracy. The National Republican Senatorial Committee announced Thursday that it is adding a “seven-figure” investment in Arizona just weeks after the top GOP super PAC cut its advertising dollars in the state to spend elsewhere. Senate Leadership Fund, the super PAC closely aligned with Senate Minority Leader Mitch McConnell, first announced in August it was halving its ad spend in the state, then decided in late September to cancel the rest of its ad reservations there — more than $17 million in total.The blow has cast doubt on whether Masters could still be viable in the general election against Democratic Sen. Mark Kelly, who has proven to be a prolific fundraiser. Rodgers: EXCLUSIVE: Rep. Claudia Tenney Sounds Alarm On New York Voter Registrations Missing Critical Information

The Public Interest Legal Foundation (PILF) released a report in October and found that 3.1 million voter registrations in New York were missing critical personally identifiable information (PII). In the letter first obtained by the Daily Caller, Tenney demanded the DOJ enforce the federal Help America Vote Act of 2002 (HAVA), which requires states to collect PII when accepting voter registrations. PILF’s report tracked totals of registered voters across the country for those who did not provide Social Security or driver’s license numbers over 2021 and 2022, and found a large number of registrants missing these identifiers.

HAVA prohibits states from accepting voter registration applications without PII, such as the last 4 digits of an individual’s Social Security Number or a driver’s license number if an individual has one.

Nina Hachigian is currently serving in the newly created State Department position of “Special Representative for Subnational Diplomacy.” Hachigian will be tasked with developing the department’s ties with cities in the U.S. and abroad, but she previously worked with multiple groups to foster closer ties between the U.S. and China, according to the Free Beacon.

The decision of whether Hunter will ultimately be charged is up to Trump-appointed United States Attorney David Weiss, individuals with knowledge of the probe told the Washington Post in a Thursday report. Weiss was appointed to the position in 2017. Hunter is reportedly under investigation for tax fraud, money laundering, and gun and foreign lobbying violations. Hunter has reportedly tried to settle the case out of court and has paid $1 million to the IRS to evade conviction or a long sentence. President Joe Biden’s Attorney General Merrick Garland has refused to say whether a special counsel should be placed over the investigation to maintain a just probe. A special counsel would provide distance from Joe Biden and the investigation into Hunter and the Biden family business dealings.

Komodo Health Inc analyzed its database of U.S. insurance claims and other medical records on about 330 million Americans. The analysis, which Reuters says is the first of its kind, found that at least 121,882 children ages 6 to 17 were diagnosed with gender dysphoria from 2017 to 2021. In 2021, Reuters reports about 42,000 children and teens across the United States were diagnosed with gender dysphoria, which is nearly triple the number in 2017, and up 70% from 2020, according to the data Komodo compiled. Over the five-year period from 2017 to 2021, the number of children with a gender dysphoria diagnosis who started on puberty-blockers or hormones totaled 17,683, rising from 2,394 in 2017 to 5,063 in 2021, according to the analysis. Of these, 4,780 patients had initiated puberty blockers and 14,726 patients had initiated hormone treatment.

McFarland: Books In Wyoming School Library ‘Groom’ Children, Says Sex Crimes Investigator

Graphic scenes in children’s books make minors more vulnerable to sex crimes, according to a longtime investigator who now runs a nonprofit organization aimed at preventing and combating child sexual abuse. Thomas Hampson, of Illinois, has voiced concerns to Cowboy State Daily regarding two books that survived challenges Sept. 1 and remain in the Kelly Walsh High School library in Casper. The books are “Gender Queer” by Maia Kobabe and “Trans Bodies, Trans Selves” by Laura Erickson-Schroth with other contributors. Cowboy State Daily reviewed and roughly summarized both books on Thursday.

Hampson called them pornographic. “(These books) destroy childhood innocence,” said Hampson. “Parents, churches and government should be in the business of protecting childhood innocence, not destroying it.”

Barrett was a guidance counselor, and was assigned to the victim. “[The victim was] transgender and was living as a male when he began at Freedom High School,” the plea agreement said. “He began the physical and hormonal transition process while he attended Freedom High School.”

A series of four studies by researchers from the United States, Chile, Australia, South Korea, Poland, Japan, Denmark, and Serbia has concluded that “[t]he motivation to care for children is consequently among the fundamental drivers of human behaviour, but its power to shape social attitudes and cognition is under-appreciated.” The studies revealed “cross-cultural and experimental evidence suggesting that parental care motivation leads to increases in socially conservative attitudes, and that parenthood is associated with social conservatism around the globe.” The report lends credibility to the colloquial use of such phrases as, “You’ll understand when you have children of your own,” and directly calls into question the link between conservatism and wisdom through age, versus conservatism as a result of parenthood.

Her son, Tom Mortier, found out the next day when a Belgian hospital asked him to make postmortem arrangements for his estranged mother.

Mortier knew his mother suffered from depression her entire life but had no idea she was considering euthanasia. “My mother … was treated for years by psychiatrists and, sadly, she and I lost contact for some time,” he said. “It was during this time that she died by way of lethal injection. Never could I have imagined that we would be parted forever.” […] Advocacy group Alliance Defending Freedom’s International Deputy Director Robert Clarke represented Mortier in the case before the court. Clarke rightly bemoaned the court’s insistence that more “safeguarding” can adequately protect the right to life under the convention. “The reality,” said Clarke, “is that there are no ‘safeguards’ that can mitigate the dangers of the practice [of euthanasia] once it is legal.” In response to the ruling, Mortier expressed his hope of igniting awareness of the “immense harm” euthanasia inflicts on patients and their families. “The big problem in our society,” he said, “is that, apparently, we have lost the meaning of taking care of each other.” Rather than reconnect an aggrieved patient with the family that could uplift and sustain her, de Troyer was offered virtually unfettered access to a “legal” practice that, in an instant, absolves everyone involved of their responsibilities: . . .
