Romoser: John Roberts is the chief. But it’s Clarence Thomas’s court.

When the Supreme Court returns to the bench on Monday for its first oral arguments of the new term, Justice Clarence Thomas almost certainly will ask the first question. Thomas, who was appointed in 1991, is the court’s longest-serving justice and was for many years its most taciturn member. He famously went a decade without asking a single question. But when the court tweaked its argument format during the pandemic, Thomas began speaking up. He now interrogates the lawyers during nearly every case, often marking the terrain on which the case will be fought. The other justices have even agreed to defer to Thomas at the start of each argument before jumping in themselves. The rationale is that Thomas, a stickler for politeness, dislikes interrupting the advocates or his colleagues. But it’s hard not to view the arrangement as symbolic of Thomas’s remarkable ascendance. Long considered an outlier on the court’s right flank, Thomas is now the intellectual leader of a conservative transformation that the six Republican-appointed justices are ushering into American law. Kern: SCOTUS to hear challenge to Section 230 protections

Clarence Thomas has been alluding in previous dissents on other court cases that it is time for the Supreme Court to decide whether Section 230 provides tech companies overly broad liability protections. The Supreme Court on Monday agreed to hear a case that threatens tech companies’ broad immunity to lawsuits over content hosted on their platforms. The case marks the first time the highest court will weigh in on Section 230 of the 1996 Communications Decency Act that protects platforms from being sued over most third-party content on their sites. The court will decide in the case of Gonzalez v. Google LLC whether those protections are too far-reaching when it comes to recommendations of terrorist videos from Google’s YouTube. The decision follows split federal appeals court rulings on the constitutionally of state social media laws — which could also be heard by the Supreme Court this term as well.

Postell: How FTC v. Walmart Has Become Walmart v. Fourth Branch of Government

It looks like Walmart and the administrative state are going to court. The case has the potential, however, to affect not only Walmart, but also the entire federal bureaucracy. The Federal Trade Commission has sued the retail giant, seeking civil penalties in what Walmart is calling “an egregious instance of agency overreach” undertaken in spite of a “lack of constitutional or statutory authority.” The FTC alleges that Walmart did not do enough to protect its customers from scams run by money-transfer services offered inside the company’s stores. Walmart has responded to the FTC’s lawsuit by challenging the agency’s very constitutionality, and its argument could affect the legal status not only of the FTC, but of other agencies across the administrative state. […] Some of our most powerful administrative agencies are independent regulatory commissions, such as the Securities and Exchange Commission, the Federal Communications Commission, and the National Labor Relations Board. If all of their executive powers are unconstitutional, the fourth branch of government may lose a significant amount of its independence from the president. For those who think the Constitution creates three branches of government rather than four, that would be a welcome change.

The Center Square Staff: DNC wants to block lawsuit over incomplete absentee ballots

The DNC on Monday filed to join the lawsuit seeking to allow local election clerks to continue filling in missing information from ballots they receive this fall. The Republican-led legislature and a Waukesha County judge have said the Wisconsin Elections Commission overstepped its bounds with its guidance that allows local clerks to complete absentee ballots without reaching out to voters first. Could Harris refuse to count these suspect votes, deprive a Republican of enough electors to win, and award the Presidency to incumbent Joe Biden, or even herself? President Donald Trump’s challenge to the 2020 elections revealed ambiguities in our electoral system that might encourage Harris to execute this very maneuver.

What’s more, it’s clear that the media are engaging in *deliberate* misinformation. These aren’t innocent mistakes. Consider this article in @FT claiming that “hurricane frequency is on the rise,” based on NOAA data. But NOAA says “After adjusting for a likely under-count of hurricanes in the pre-satellite era there is essentially no long-term trend in hurricane counts.” In fact, NOAA writes, “The evidence for an upward trend is even weaker if we look at U.S. landfalling hurricanes, which even show a slight negative trend beginning from 1900 or from the late 1800s.” In other words, the graphic @FT chose to show of apparently rising hurricane frequency is, in reality, a graphic showing improved hurricane detection thanks to satellites. What are the chances that FT reporter @Aime_Williams didn’t know this? I would guess close to zero. […] What about intensity? Same story. Writes NOAA, . . . […] And now it’s clear that activist scientists at the UN are working with Google to control the information available on climate change. This is dark, chilling stuff.

The war in Ukraine has become, or always was, Biden vs. Putin. But there is a key difference in the players. Biden is old and fading. He’s senile. He may serve out his term. In Soviet Russia—’scuse me, modern post-Soviet Russia—existential still has real meaning. All of that is obvious and was even before the war in Ukraine began. But the United States and NATO joined the war effort anyway. Now we are told Russia is losing, prompting the question: What comes next?

The seven month old War in Ukraine that began with a Russian invasion has been an interesting phenomenon to watch, not from a viewpoint of “war”, but from a political angle. One of the players that was a part of the Russia-gate Trump Spying Scandal. […] The whole thing, to be honest, is nothing more than an “opportunity” for the global cabal and hard left baddies who are itching to do what they can to: 1. Increase their level of power. 2.Make sure nobody like Trump ever has a chance to take part in their power play to eliminate liberty and replace it with tyranny in their iron clasp.

According to Arlington, the woman holds a laurel wreath, a plow stock and a pruning hook, with a biblical inscription at her feet that says: “They have beat their swords into plough-shares and their spears into pruning hooks.” This decision (if it comes to pass) is an atrocity. The monument at Arlington is indisputably a brilliant work of art, of the sort America is incapable of replicating today.

Buried more than two dozen paragraphs into the NYT article is a quiet confirmation that, regardless of Perla, the migrants not only agreed to get on the plane voluntarily but that they knew their final destination was the wealthy East Coast island of Martha’s Vineyard.

Whitmer’s Children’s Services Agency on September 12 issued a contract proposal for a “Sexual Orientation, Gender Identity, and Expression (SOGIE) Consultant” to assist the agency’s “Diversity Equity and Inclusion Unit,” documents obtained by the Washington Free Beacon show. Included in the proposal are directives to distribute surveys on “the needs and concerns of LGBTQIA+ … children,” develop “training curriculum” on topics such as “implicit bias,” and identify “community services for Native American Two Spirit youth.”

A BIG WIN FOR SCHOOL CHOICE

This July, Arizona became the first state to embrace universal school choice by enacting legislation that allows all students to participate in the state’s Empowerment Scholarship Account (ESA). Approximately 12,000 students currently enroll in the ESA program, which deposits 90 percent of the state’s share of per-pupil education funds—about $7,000 per child—into an account that parents can use for various educational costs. Qualified expenses include: private school tuition, micro-schooling, homeschooling, tutoring, and online classes. Previously, the ESA program limited student eligibility to, for example, kids with disabilities, children attending failing public schools, children of active-duty military parents, foster children, and siblings of current or former ESA participants. With the new law, an estimated 60,000 students currently enrolled in private schools and 38,000 homeschooled students are immediately eligible for ESA funding, and 1.1 million children attending district and charter schools have the option to get funding as well. School-choice foes gathered signatures to introduce a November 2024 ballot initiative to invalidate the legislation. On September 24, one day before the law expanding the ESA was to take effect, the organization behind that effort, “Save Our Schools Arizona,” temporarily blocked the expansion . . .

Jones: D.C. Mayor Helping 20,000 Black Residents Buy Homes, ‘Build Generational Wealth’

Muriel Bowser, the mayor of Washington, D.C., joined other city officials on Monday in announcing a new goal to make 20,000 additional black D.C. residents homeowners by 2030.The plan, developed by the Black Homeownership Strike Force, comes with ten recommendations, including help with down payments, financial assistance for home repairs, and foreclosure avoidance, among others. “This goal is a first step in undoing the lasting legacy of discriminatory housing laws that locked many Black families out of homeownership throughout the twentieth century,” Mayor Bowser said in a news release.

Maitland Jones Jr., 84, had 82 of his 350 organic chemistry students sign the petition citing Jones’ teaching methods and course outline as reasons for their poor grades. ‘We are very concerned about our scores, and find that they are not an accurate reflection of the time and effort put into this class,’ the petition said, according to a New York Times report. ‘We urge you to realize that a class with such a high percentage of withdrawals and low grades has failed to make students’ learning and well-being a priority and reflects poorly on the chemistry department as well as the institution as a whole.’ […] Kent Kirshenbaum, another organic chemistry professor, discovered students cheating during online tests. Citing poor conduct in his decision to reduce grades, students protested by saying ‘they were not given grades that would allow them to get into medical school.’ Entering 2022, Jones said students were increasingly disengaged. ‘They weren’t coming to class, that’s for sure, because I can count the house,’ Jones said. ‘They weren’t watching the videos, and they weren’t able to answer the questions.’

Nor does he think there’s anything wrong with taking campaign money from Kevorkian’s defense attorney. As prosecutor, Carl Marlinga was in charge of investigating a potential homicide by Kevorkian. Hugh Gale, sick with emphysema, was found dead at the age of 70 from inhaling carbon monoxide from a machine created by Kevorkian, and evidence found by a local Macomb County, Mich., resident indicated that Gale’s death was manslaughter at the hands of Kevorkian, whose critics alleged he was getting away with killing vulnerable individuals like Gale for years. One of Kevorkian’s assistants left a journal entry in a garbage bag that suggested Gale asked that his carbon monoxide mask be removed in the middle of the procedure, indicating he did not want to follow through with his assisted suicide.
