Widburg: The Eleventh Circuit’s unconstitutional ruling against Trump

The Eleventh Circuit issued an unconstitutional ruling against President Donald Trump in the Mar-a-Lago matter. The U.S. Supreme Court has made clear that the president himself, not any other part of the U.S. government, has the final say over what constitutes a classified document. No one can second-guess the president, yet that’s what the Eleventh Circuit did by issuing an order ceding control over classification decisions to the Department of Justice. A district court judge granted Trump’s motion for a special master to review the documents the FBI seized from his property, many of which Trump argued were privileged. The DOJ appealed, seeking a stay of the order as it related to documents it claims are classified. The appellate court framed the issue this way: . . . […] The real question is who gets to decide whether documents are classified. Is the answer bureaucrats and judges whom, the American people did not elect, or the American president, who has complete and total (that is, plenary) power over the entire issue of information classification?

The tragic events of 9/11 marked a turning point in our nation’s recent civil rights history. First the terrorists attacked us—and then, in the name of national security, we began to attack ourselves. It has become almost cliché to say that we live in a surveillance state, but we do. Ever since Congress, on a fully bipartisan basis, enacted the Patriot Act six weeks after the attacks on 9/11, the ever-present eye of the government has been searching for new and creative ways to spy on American citizens. The government has the technology to monitor all of our electronic devices, listen to our phone calls, and read our emails and text messages—all under the auspices of national security. This special law designed for an emergency has become a permanent addition to the government’s investigatory toolbox. The unfortunate reality is that the bulk of the actions taken by law enforcement under the Patriot Act have almost nothing to do with combating terrorism. Once-rare applications for surveillance warrants to the Foreign Intelligence Surveillance Court have multiplied many times in relative peacetime. Most of the spying conducted under the Patriot Act is for run-of-the-mill crimes that we’ve long expected law enforcement to address without special surveillance authority. Now, it is bad enough to have a politically-neutral surveillance state controlled by the national security crowd and their DOJ cousins. But take that panopticon and put it in the hands of an executive branch willing to weaponize its reams of information against its perceived political enemies, and we’ve got a frightening problem on our hands.

An FBI whistleblower warned that the bureau has been transformed from a law enforcement agency to an intelligence-gathering operation that spies on law-abiding Americans to help advance a political agenda and said thousands of agents and employees feel betrayed by the bureau’s leadership. Kyle Seraphin told podcaster and radio host Dan Bongino over a bombshell, two-part interview that agents are routinely directed to spy on Americans with little or no basis, the bureau’s management ranks are hopelessly politicized by inexperienced corporate climbers, and that hundreds of experienced agents are staying on despite their disgust simply to collect their pensions.

A whistleblower lawyer representing an FBI agent suspended after raising concerns about the treatment of Jan. 6 suspects says the bureau is using its control of security clearances to silence and punish critics. Jason Foster, a former Senate investigator and head of the Empower Oversight whistleblower group, told Just the News on Monday his group is helping to represent Special Agent Stephen Friend, who last week made a whistleblower complaint to the Office of Special Counsel alleging he was suspended after raising concerns about treatment of Jan. 6 suspects, the use of SWAT teams and alleged manipulation of crime statistics. Foster said the bureau was able to sideline Friend last week by suspending his security clearance pending a review, essentially leaving the agent in limbo and unable to do his job. Foster was asked whether he knew of any wrongdoing that Friend committed that would warrant suspending his security clearance. “No, absolutely not,” he answered.

That natural rhythm came to a halt in 2021 once the vaccine rollout began. Doctors for Covid Ethics posted an interview with her where she shared her concerns about unusual features that have been showing up in samples from the past year. Age – The average ages of the samples she received dropped, with a rise in the number of samples from people in their 30’s-50’s. Size – It used to be unusual for Dr. Kruger to find a tumor 3 cm in size. In this new environment, she’s regularly seeing tumors of 4 cm, 8 cm, 10 cm, and the occasional 12 cm. In a shocking anecdote, 2 weeks ago she found a 16 cm tumor that took up an entire breast. Multiple Tumors – . . .

Recurrence – . . .[…] Dr. Kruger initially thought that these turbo cancers, as she calls them, were due to delayed doctor appointments from Covid lockdowns, but that period is long over, and the tumors are still growing aggressively, and in younger patients. She reported some of these cases to the FDA, and while some higher-ups initially agreed to meet with her, they canceled the meeting with no explanation the next day and sent a phone agent to take her report instead.

[…] The report asserted that between 1987 and 2021, at least 162 scientists who passed through the nuclear research lab returned and worked with the Chinese government. Of these, 15 were permanent staff members, many carrying very high levels of security clearances.

The endless negotiations seem simply to have bought time for the mullahs, so that they could comfortably advance their nuclear program to their highest level ever. Not only has the Biden administration seen no urgency to change its disastrous path, it is actually redoubling efforts to for Iran talks, presumably after America’s mid-term election on November 8. Iran’s regime, which has long claimed that it is not seeking to develop nuclear weapons because of the Supreme Leader’s reported “fatwa” forbidding such an act, has now changed its tone and is bragging that it has currently the ability to build a nuclear bomb. Kamal Kharrazi, Iran’s former foreign minister, pointed said to Al Jazeera recently that “It’s no secret that we have become a quasi-nuclear state. This is a fact. And it’s no secret that we have the technical means to produce a nuclear bomb.” He added, “In the past, and within just a few days, we were able to enrich uranium up to 60%, and we can easily produce 90% enriched uranium. But what we want is a Middle East without any nuclear weapons” – most likely meaning just their nuclear weapons, not anyone else’s. Some Iranian leaders have also admitted that the regime’s nuclear program was always designed to manufacture nuclear weapons. Former deputy speaker of the Iranian Parliament Ali Motahari, for instance, disclosed in April: . . .

We can view that approach as basically defensive in nature. But now we see a shift to the offense: open and aggressive pushing of, let’s see, “queer”, “transgressive”, “kink”, etc. You get the picture. Love is love? Please. It’s not about holding hands, as naive people think. Check out this Rod Dreher title: Why Does The NEA Want Kids To Learn Butthole-Licking? I apologize for being gross, but it’s necessary. You have to be shocked into recognizing the moral horror of what a part of the nation’s largest teacher’s union is doing. It is unspeakable, but we have to speak about it.

Sure enough, moments later, we were unable to send or receive email.

Elizabeth II understood her duty—do we? On the evening of September 8, as mourners began to gather outside Balmoral Castle to grieve the death of their monarch, their monarch was inside, grieving too. In the U.K., the transition from one monarch to the next is instantaneous. At the moment of Queen Elizabeth’s death, her son, Prince Charles, became the King. The person may die, but the monarchy lives on. The Queen is dead, long live the King.

In the last analysis, a monarch is not a person. A monarch is a symbol—a country in human form. In the age of constitutional monarchy, this is really the monarch’s only job. Not just to represent his country, but to become it.

No one really seeks this responsibility out, or chooses it for himself. And by necessity it often comes at a moment of great personal grief.

On Sunday, Italian voters elected their most conservative government in decades, putting Giorgia Meloni, the leader of the Brothers of Italy Party, on track to become the nation’s first female prime minister. “Partial results place the Brothers of Italy on 26 per cent, making it the leading party, with Meloni’s allies Matteo Salvini, 49, the leader of the League, on 9 per cent and Silvio Berlusconi’s Forza Italia on 8 per cent,” The Times, a U.K.-based outlet, reported. “The coalition’s combined share of more than 40 per cent is likely to translate into majorities in both houses of parliament thanks to electoral law, which benefits party alliances.” […] This is Italy’s new Prime Minister Giorgia Meloni.
