Malone: Anatomy of the Administrative State: The HHS

Many have come to believe that if Dr. Anthony Fauci either resigns or is removed from his position as Director of the The National Institute of Allergy and Infectious Diseases (NIAID), then the whole COVIDcrisis problem of chronic, strategic and tactical administrative overreach, dishonesty, mismanagement and ethical breaches within the US Department of Health and Human Services (HHS) would be resolved. Under this theory, Dr. Fauci is responsible for policies which were developed during the AIDScrisis and then flourished during the COVIDcrisis, and once the tumor is removed the patient will recover.

I disagree. Dr. Fauci represents a symptom, not the cause of the current problems within HHS. Dr. Fauci, who joined the HHS bureaucracy as a way to avoid the VietNam draft and personifies many of the administrative problems that have accelerated since that period, would merely be replaced by another NIAID Director who might even become worse. The underlying problem is a perverted bureaucratic system of governance which is completely insulated from functional oversight by elected officials. The “administrative state” is a general term used to describe the entrenched form of government that currently controls almost all levers of federal power in the United States, with the possible exception of the Supreme Court of the United States (SCOTUS). The premature leaking of the SCOTUS majority decision concerning Roe v Wade to corporate press allies was essentially a preemptive strike by the administrative state in response to an action which threatened its power. […] Examples such as these, where personal speech is either censored or punished, are becoming much more frequent, and anybody who minimizes the threat this increased intolerance for free expression poses to a democratic society is either gullibly or willfully blind. As any defender of liberty knows, nothing more quickly transforms a free society into a totalitarian prison than crackdowns on speech. Of all the tools of coercion available to a government, preventing individuals from freely expressing their thoughts is most dangerous. Denying citizens that most basic societal release valve for pent-up anger and disagreement only heightens the risk for outright violence down the line. Either silenced citizens become so enraged that conflict becomes inevitable, or the iron fist of government force descends on the public more broadly to preemptively curtail that possibility. Either way, the result is a disaster for any free society. […] It is a slippery slope, is it not? Once governments normalize censorship and the punishment of points of view, free expression is firmly stamped with an expiration date.

Mittelstadt: DOJ contradicts federal law with lawsuit against Arizona citizenship voter law

The Department of Justice is planning to sue Arizona over its law requiring voters to prove their U.S. citizenship, contrary to federal law. Arizona House Bill 2492, signed by Gov. Doug Ducey (R) in March, requires voters to provide proof of citizenship to vote in the state. In a letter to Arizona Attorney General Mark Brnovich, the DOJ claims the law violates both the National Voting Registration Act of 1993 (NVRA) and the Civil Rights Act of 1964. According to the DOJ, the Arizona law violates the NVRA because the federal law “requires Arizona to ‘accept and use’ the Federal Form, a voter registration form prescribed by the U.S. Election Assistance Commission pursuant to federal law, to register qualified voters for all elections for federal office.” The DOJ also claims the Arizona law violates the “Materiality Provision” of the Civil Rights Act, which provides that “No person acting under color of law shall … deny the right of any individual to vote in any election because of an error or omission on any record or paper relating to any application, registration, or other act requisite to voting, if such error or omission is not material in determining whether such individual is qualified under State law to vote in such election.”

The Southern Poverty Law Center, a left-wing advocacy organization known for labeling Christian and conservative organizations as “hate groups,” has been providing research and testimony to the Jan. 6 Committee, according to Politico. “Over the past few months, our SPLC analysts have met with Jan. 6 Select Committee staff and submitted nearly 40 pages of written testimony and research to document the involvement of extremists in the planning and preparation for the insurrection,” Michael Lieberman, senior policy counsel on hate and extremism at the SPLC, told Politico in a statement. “Our work has helped to document coordination between Trump, his allies and two extremist groups we’ve tracked for years.”

Whittaker: Judge Strikes Down Los Angeles School District’s Vaccine Mandate

The Los Angeles Unified School District (LAUSD) student COVID-19 vaccine mandate was struck down on Tuesday by a Superior Court judge, who ruled that the nation’s second-largest public school system had exceeded its authority by imposing requirements beyond those of the state of California.

The decision did not have an immediate effect, as the proposed mandate had been postponed until July 2023, but the district’s school board was resolute in its defense of the policy. It is unclear if board members intend to appeal the decision.

The North Atlantic Treaty Organization’s secretary general confirmed NATO is boosting its forces in Europe to “well over 300,000” from the current 40,000, a 650 percent increase. NATO Secretary General Jens Stoltenberg claims it’s to respond to the Russian invasion of Ukraine. Setting aside the obvious ridiculousness of NATO boosting a deterrence force, however, at the very same time Russia is failing to conquer even Ukraine and is increasingly bogged down, such euphemisms from NATO are jarring. Everyone understands this means U.S. taxpayers will carry an additional burden for European security.

Consider the details: President Biden will deploy additional troops to Romania and the Baltic states, establish and maintain the permanent Fifth Army Corps in Poland, send two F-35 squadrons to the United Kingdom and air defenses to Germany and Italy, and increase the number of destroyers stationed in Spain from four to six. The new additions are so bizarrely out of proportion to the threat that it provoked one of the most hawkish Republicans, Florida Sen. Marco Rubio, to question why Biden is reinforcing Europe at the cost of the Pacific: “Russia’s military is in no condition to invade anyone else right now and its China & North Korea who are threatening military aggression,” Rubio tweeted.

[…] Now we learn that a huge chunk of this oil has gone abroad — to Europe, which, like the grasshopper that never bothered to save for a rainy day, what with Putin on the march demanding to be paid in rubles for his oil and natural gas, has left the continent short. Putin’s doing great on the price of petroleum, having lots of markets to sell to if Europe won’t buy from him, and the Russian ruble has strengthened. Worse still, a lot of this SPR release has gone to Asia, particularly China, which isn’t using it to fuel gas stations. Martinez: Texas counties declare ‘invasion’ during border crisis: ‘We’re being invaded’

Several Texas counties declared a border “invasion” on Tuesday in a move to pressure the state’s governor to issue a similar declaration. The statement doesn’t grant the counties any kind of additional legal authority and may not even be legal — but officials hoped it would bring attention to the border crisis.

“We’re being invaded. The facts are there,” said Kinney County Judge Tully Shahan at a press conference in Brackettville, Texas. “This is real. We want America to know this is real. America doesn’t know what’s happening here.” County officials from Kinney, Goliad, Terrell and Uvalde Counties criticized the Biden Administration for what they called its “open border policy.”

Lyman: Potential Virginia Mass Shooters Were In US Illegally, One Deported Multiple Times, Police Say

Two men who were allegedly plotting a mass shooting in Virginia are in the state illegally, with one of the men having been deported several times, according to authorities. Richmond Chief of Police Gerald Smith said during a press conference Wednesday that “a hero citizen picked up the phone and overheard a conversation there was a mass shooting being planned here in the city of Richmond, Virginia,” according to NBC 12. […] Authorities arrested 52-year-old Julio Alvarado-Dubon and 38-year-old Roman Balacarcel, who allegedly planned to shoot up Richmond’s Fourth of July celebration. Both men were charged with being non-citizens in possession of a gun. Smith said the men are roommates.

Few noticed or cared when U.S. education secretary Miguel Cardona announced on June 14 the launch of the National Parents and Families Engagement Council (NPFEC). The NPFEC “…will serve as an important link between families and caregivers, education advocates and their school communities. The Council will help foster a collaborative environment where we can work together to serve the best interest of students and ensure they have the academic and mental health support they need to recover from the pandemic and thrive in the future.” While this sounds promising, a journalist with Tony Perkins’ Family Research Council (FRC) in their Washington Stand newsletter took an interest and identified some major red flags; “Yet one look at some of the council’s 14 acknowledged members shows it represents a small segment of elitist, left-wing views.” For example: The National Action Network started by Al Sharpton made an “LGBTQ Alliance” in 2015 “…to promote “the hiring or participation of gay/transgender people “in all areas of religious and public life.” Girls, Inc. supports abortion, comprehensive sex- ed, gender transition procedures for young people, and promotes critical theory. UnidosUS, . . . […] The National Association for Family, School and Community Engagement (NAFSCE) . . . […] The United Parent Leadership Action Network (UPLAN) . . . […] Generations United . . . […] Based on the above, we can conclude Biden’s council is a hyper-partisan packed court (not unlike the makeup of the Jan. 6 Commission) that is likely to dismiss any family input that differs from their progressive views.

A federal appeals court in New Orleans heard arguments Wednesday on the legality of the Obama-era Deferred Action for Childhood Arrivals program, setting up another high-stakes legal clash over immigration that could impact hundreds of thousands of people. DACA, created in 2012, was intended to provide temporary reprieve to undocumented immigrants who were brought to the United States as children, a group often described as “Dreamers.” Many of those are now adults. There are more than 611,000 immigrants enrolled in the program, according to US Citizenship and Immigration Services. The case before the 5th US Circuit Court of Appeals Wednesday could impact hundreds of thousands of immigrants who rely on the program as well as those who might benefit.

Sri Lanka has been wracked with poverty, inflation and fuel shortages on a massive scale, with the Prime Minister declaring Tuesday that the country has gone “bankrupt,” according to Business Insider. A ban on chemical fertilizers, implemented April 2021 in an effort to promote organic farming, proved the final straw after a string of missteps, decimating Sri Lanka’s primary source of income and forcing it into bankruptcy, experts told The Daily Caller News Foundation. “Our economy has faced a complete collapse,” Prime Minister Ranil Wickremesinghe said on June 23, according to CNN. The government lifted the fertilizer ban in November 2021, but the damage had already been done, Peter Earle, a former financial markets trader and economist at the American Institute for Economic Research, told TheDCNF.
