Gould: The Supreme Court’s CMS Decision Bodes Ill for the Rule of Law
The recent U.S. Supreme Court decisions around mask mandates have understandably generated a great deal of media coverage and comment. Many conservatives have praised the Supreme Court’s decision to affirm the stay on the nationwide OSHA vaccine mandate. But as a lifelong prosecutor and judge, I can assure you the true and most significant factor has been overlooked. Specifically, based on the Court’s decision to vacate the stay on vaccine mandate for healthcare workers (the Centers for Medicare and Medicaid Services, or “CMS” mandate), the president, with no constitutional or legal authority, has been allowed to order ten million healthcare workers to receive a vaccine or risk losing their jobs and their livelihood. And while state legislatures, exercising their police powers, have imposed vaccine requirements on healthcare workers in the past, no president has imposed a nationwide mandate involving such a permanent, personal healthcare decision. Simply put, as Judge Sutton recently stated in In re MCP No. 165, unlike masks or gloves, “vaccines cannot be removed at the end of the shift.”

Lewis: Will the Supreme Court Rein in the EPA?
The Supreme Court will soon hear oral argument in West Virginia v. Environmental Protection Agency. The Court will examine the lawfulness of the Obama administration’s October 2015 Clean Power Plan (CPP) and the Trump administration’s June 2019 Affordable Clean Energy (ACE) Rule, which repealed and replaced the CPP. Both rules target power plant carbon dioxide (CO2) emissions. However, ACE aimed to improve the environmental performance of coal power plants (measured in pounds CO2 per megawatt hour), whereas the CPP aimed to squeeze coal power plants out the electricity marketplace.

Cheney: Jan. 6 select committee zeroes in on another Alex Jones associate
Court documents filed Sunday evening reveal the panel has subpoenaed records for Annette Shroyer, the mother of Jones employee Owen Shroyer, who was charged last year for his participation in the Jan. 6 breach of Capitol grounds. Annette Shroyer is asking a judge to let her join Jones’ pending lawsuit against the Jan. 6 select committee, claiming the subpoena is an abuse of the committee’s power.

Spencer: After Sanctions on Russia Fail, Biden Lies About Why He Imposed Them
After over fifty years in public life, Old Joe Biden has a well-deserved reputation for dishonesty, and he added to it Thursday while trying to save face after Vladimir Putin ignored his sanctions threats and invaded Ukraine. The sanctions, you see, were intended to stop Putin in his tracks. When they failed to do so before the eyes of a watching world, Biden did not, of course, admit that he had miscalculated or underestimated Putin. Instead, he simply changed his story, with all the insouciance he displayed as a young Syracuse University College of Law student plagiarizing a law review article. He must think no one is paying attention. Biden emphasized Thursday that the sanctions were not meant to stop Putin from invading Ukraine or to get him to call off the invasion. “No one expected the sanctions to prevent anything from happening,” he claimed. “This could take time and we have to show resolve so he knows what’s coming and so the people of Russia know what he’s brought on them, this is what this is all about. This is going to take time, it’s not going to occur … he’s gonna say ‘Oh my God, these sanctions are coming, I’m gonna stand down.’” Well, all right, Joe, but why does no one on your team seem to know this? One of the oddest commentaries about the Russian invasion of Ukraine is the boilerplate reaction that “borders can’t change in modern Europe” or “this does not happen in the 21st century.” But why in the world should the 21st century be exempt from the pathologies of the past 20 centuries? Are we smarter than the Romans? More innovative than the Florentines? Do we have more savvy leaders than Lincoln or Churchill? Are they more mellifluous than Demosthenes? Does anyone now remember that some 130,000 were slaughtered just 30 years ago in the former Yugoslavia, as NATO planes bombed Belgrade and nuclear America and Russia almost squared off? Current CIA Director William “Bill” Burns was the former ambassador to Russia and Jordan. Bill Burns had a 33-year career at the State Department under both Republican and Democratic presidents and speaks fluent Russian. If the people in the background of Joe Biden wanted an intelligence operative to trigger a specific result from Russia, there’s no one more strategically perfect for the job than CIA Director Bill Burns. The article by Beinart is mainly focused on pointing out the irreconcilable nature of Joe Biden implying Ukraine could join NATO, while his own CIA Director has a history of giving serious warnings emphasizing the “brightest of all red lines” about that specific point.

Russia expected to waltz in to Ukraine. It didn‘t. Russian forces have failed in all their objectives. A thousand Russian soldiers die each day of the assault. In the four days prior to this writing, 4,000 have died. This is twice the number of American deaths in Afghanistan over twenty years.
(And no, Kyiv was never surrounded, and President Volodymyr Zelenskyy lives. Indeed, the airport near Kyiv was retaken by local Ukrainian forces; in essence state-level reservists, who retook the airport from Russian elite troops.)What this means is that the myth of Russian might has been broken for all time.

Aare: EU buys weapons for Ukraine, closes its airspace to Russian aircraft
The European Union on Sunday announced plans to close its airspace to Russian planes, and fund weapons for Ukraine to defend against Russia’s invasion of its western neighbor, according to international officials. “We are proposing a prohibition on all Russian-owned, Russian registered, or Russian-controlled aircraft,” European Commission President Ursula von der Leyen said. “These aircraft will no more be able to land in, take off or overfly the territory of the EU.”
