While Sussmann has been charged with giving false statements to then-FBI General Counsel James Baker regarding the Alfa Bank/Trump Organization hoax (background here), Durham notes that the “Government also maintains an active, ongoing criminal investigation of” Sussmann’s conduct. In other words, Sussmann’s criminal conduct likely is not limited to false statements. There is more. If we are to make an educated guess, it may have to do with . . .

Jansen: Feds looking at fake 2020 elector certificates for potential criminal charges, DOJ official says

The Justice Department is weighing whether to press criminal charges over fake Electoral College certifications in the 2020 election, Deputy Attorney General Lisa Monaco told CNN on Tuesday. “Our prosecutors are looking at those and I can’t say anything more about ongoing investigations,” Monaco told CNN.

Disputes about state electors were at the heart of former President Donald Trump’s attempt to thwart the counting of Electoral College votes on Jan. 6, 2021, when a mob ransacked the Capitol and temporarily halted the count. […] The fake certificates, which falsely declared Trump the victor in several states that President Joe Biden won, were sent to the National Archives by Trump’s allies in mid-December 2020. Monaco didn’t detail what prosecutors are reviewing in terms of the 2020 vote count. But Monaco said the department would “follow the facts and the law, wherever they lead, to address conduct of any kind and at any level that is part of an assault on our democracy.”

Republicans consider shutting down government over vax mandate

Several Republicans are considering shutting down the government if the next funding bill includes money for federal COVID-19 vaccine mandates. Fox News Digital exclusively obtained a letter signed by a growing number of Republicans, led by Rep. Chip Roy of Texas, pledging to pull support from government funding legislation that includes language giving funds for vaccine mandates. The current funding for the federal government will expire mid-February, meaning Congress will have to pass a continuing resolution or appropriations legislation to keep the lights on. Roy told Fox News Digital in a Tuesday statement that he and his colleagues are “going to find out” whether the Republicans will “unite” and “pledge not to fund these mandates.” […] The letter is making its way around the Hill this week as the Feb. 18 federal funding deadline approaches, and lawmakers have until the end of the day Friday to sign on.

There are already over a dozen signers, including GOP Reps. Scott Perry of Pennsylvania, Clay Higgins of Louisiana, Paul Gosar of Arizona, and Lauren Boebert of Colorado. [Note: Contact your representatives if you want them to sign the letter.]

Mitch McConnell, R-Ky., the leader of the Senate’s Republican conference, has announced he’s not even putting out an agenda for 2022. According to reporting by Axios last month, McConnell told a room full of donors, lobbyists, and in-cycle senators that he would not be putting forward an agenda outlining the priorities for his conference should Senate Republicans regain a majority in 2022. When asked by CNN last week what the GOP agenda would be in a potential majority, McConnell responded, “That is a very good question and I’ll let you know when we take it back.” He went on, “This midterm election will be a report card on the performance of this entire Democratic government, the president, the House, and the Senate.”

In other words, McConnell and GOP senators seem prepared to run solely on a platform detailing how bad the other guy is, and that scrupulously and intentionally avoids discussing what they intend to do about it.

Vance: OSHA Should Have Been Abolished Long Before COVID

According to legal scholar James R. Rogers of Texas A&M University: “OSHA has tried to use the ETS process only nine times in its history. Of those nine ETS attempts, six were challenged in court. And of those six challenged, only one ETS was upheld.” […] The Occupational Safety and Health Administration (OSHA) should be abolished. But it should not be abolished because of anything to do with COVID-19. […] Regardless of the noble mission of OSHA, the agency is clearly exercising an unconstitutional use of federal power. It infringes on the traditional authority of the states to exercise their general “police powers” concerning public health and safety. This doesn’t mean that the states have always acted wisely or prudently, or never infringed on individual liberty and private property. But the federal government has never been afforded general police powers by the Constitution. This is what is missing from all the analysis about the Supreme Court overturning the Biden mandate. OSHA should have been abolished long before COVID-19 came on the scene. Accordingly, several Republican members of Congress have introduced a bill (H.R. 5813), the “NOSHA ACT,” to abolish OSHA. Piper: CDC study suggests unboosted vaccines become worse than nothing against Omicron

Two-dose COVID-19 vaccines may after an initial protective window become less effective against symptomatic infection by the Omicron variant than not getting jabbed at all, according to little-noticed findings in a federal study of how well boosters performed against different variants. The “adjusted odds ratio” crossed 1 for vaccinated versus unvaccinated individuals 7-10 months after vaccination, according to the “original investigation” by Atlanta-based CDC researchers, published in the Journal of the American Medical Association last week. That means the vaccinated were more likely than the unvaccinated to have symptomatic Omicron infections beginning at about the time the former become eligible for boosters. When considering the upper bound of the 95% confidence interval, the disparity emerged two months earlier.

The New York City based pharmaceutical company announced Tuesday that it is recruiting 1,420 participants for a three cohort trial that will determine the safety and effectiveness of the company’s shot. It has launched the trial despite CDC data showing that the fast-spreading variant already appears to have peaked in the US, meaning it could have largely disappeared by the time a shot is ready. […] But new data shows that the sheer infectiousness of Omicron may ultimately stop its spread.

Russia is awaiting Washington’s written response to its calls for security guarantees in Europe – including a demand for no further admissions to NATO – and will then decide on its next move, the Kremlin spokesman Dmitry Peskov said on Tuesday. The Biden administration has stated repeatedly that the demand to halt further NATO expansion is a non-starter, that the so-called “open door” policy of admitting to the alliance any aspirant that meets laid-down conditions will not change. In the epic book “The Guns of August,” Barbara W. Tuchman detailed in fascinating detail how the European powers stumbled their way into World War I. None of them wanted the conflict. “A non-Catholic Pope”? It sounds like a contradiction in terms. But those are the words used to describe Pope Francis by Archbishop Carlo Maria Vigano, the former Apostolic Nuncio to the United States. In fact, he rarely uses the term “Pope Francis.” He refers to him instead as “Bergoglio” and to his pontificate as the “Bergoglian papacy.” Vigano has a following in some Catholic circles but it’s likely that the vast majority of Catholics have never heard of him. Yet the questions he raises about Pope Francis are of great consequence, not just for Catholics but for non-Catholics as well. Since there are about 1.3 billion Catholics in the world, whoever leads them can have a significant effect on a large segment of the global population. It’s widely thought, for instance, that Pope John Paul II did more to put an end to communism in Eastern Europe than any other individual with the exception of Ronald Reagan. For evidence of the close collaboration between the two men, read historian Paul Kengor’s revealing book, A Pope and a President. Now we have a new pope and a new president and neither of them seem terribly concerned about the revival of communist power throughout the world. Munro: Healthcare Executives Import 1,000 Nurses a Month for American Jobs

About 1,000 nurses are arriving in the United States each month from African nations, the Philippines and the Caribbean, said Sinead Carbery, president of O’Grady Peyton International, an international recruiting firm. While the United States has long drawn nurses from abroad, she said demand from American health care facilities is the highest she’s seen in three decades. There are an estimated 10,000 foreign nurses with U.S. job offers on waiting lists for interviews at American embassies around the world for the required visas. This medical migration of nurses and doctors “ultimately is about the money” for the medical sector, said Kevin Lynn, founder of Doctors Without Jobs. The New York Times article admitted the central role of economics in the healthcare migration with a headline saying: “Rich Countries Lure Health Workers From Low-Income Nations to Fight Shortages.” That’s a sharp break from the newspaper’s usual migration coverage, which overwhelmingly focussed on migrant family dramas rather than economic impacts. “The medical establishment, just like any other corporation, is looking for efficiency — faster, cheaper,” said Lynn, who campaigns for American medical graduates who lose vital training slots in government-funded residency programs to imported foreign medical graduates.
