According to Texas attorney Jerri Ward, “CMS has granted ‘waivers’ of federal law regarding patient rights. In its ongoing attempt to investigate and gather information about private U.S. citizens, the Congressional 1/6 Committee is claiming virtually absolute powers that not even the FBI or other law enforcement agencies enjoy. Indeed, lawyers for the committee have been explicitly arguing that nothing proscribes or limits their authority to obtain data regarding whichever citizens they target and, even more radically, that the checks imposed on the FBI (such as the requirement to obtain judicial authorization for secret subpoenas) do not apply to the committee. As we have previously reported and as civil liberties groups have warned, there are serious constitutional doubts about the existence of the committee itself. Out of the 20 people tied to the Oath Keepers (three have accepted plea deals), only one is accused of assaulting or impeding a police officer. No Oath Keeper is charged with carrying or using a weapon; the only property charge is “aiding and abetting” the destruction of government property. None are charged with directly inflicting any damage. So what did these seditious conspirators do? For weeks, Rhodes led several group chats on an encrypted app to make plans to travel to Washington. Defendants discussed the deployment of “quick reaction forces” to the capital if necessary. Some allegedly brought guns but left them at hotels in Virginia rather than violate D.C.’s strict gun control laws. A lot of the chatter was harmless; in one exchange, a few defendants discussed whether to wear jeans or khakis. […]  Charging these men with seditious conspiracy is a new low for a vengeful attorney general and a Justice Department that has just opened a domestic terror unit to expand its prosecutorial and surveillance grip over Democrats’ political foes. The charges are not only opportunistic but cynical as well. As the government well knows, there is less than zero chance the sedition charge will see the light of day in a courtroom. The last time the Justice Department prosecuted anyone for seditious conspiracy was in 2010 and the charges were tossed by a federal judge. HOFT: Who’s “Cleaning” Our Voter Rolls? Soros Founded and Funded ERIC Is Now Used In 31 States
For decades the Democrats and leftists have fought ferociously to prevent the cleanup of State voter registration rolls. Recognizing a potential niche, left wing activists created ERIC to clean voter rolls their way, using their rules. So in 2012 the Electronic Registration Information Center (ERIC) was formed as a membership organization primarily for blue States. ERIC is essentially a left wing voter registration drive disguised as voter roll clean up. But it’s been gaining traction in Red States too. Originally funded by the Soros Open Society, it is now responsible for cleaning the voter rolls in 31 States, plus D.C. A top election official from each member State is appointed a seat on the ERIC Board or as an Officer, all unpaid positions. […]  ERIC doesn’t just manage lists, they demand action. But it’s not the action you would expect, like cleaning voter rolls. ERIC provides each member State a targeted list of people that are not registered to vote. The Membership Bylaws require the State to contact at least 95% of these people within 90 days, soliciting them to register. ERIC also wants specific registration profiles updated and requires the State to contact these voters within 90 days too. It’s essentially a left wing voter registration drive all paid for by the States, not the Democrat Party. The membership fee is $25,000 but costs can run into the millions to fund the activities and membership dues.

Students at Fairfax County’s Oakton High School were asked to self-identify their privilege for an exercise that the district says “was intended to provide students with an opportunity to reflect on their own experiences while building their critical thinking skills.” The bingo card contained squares based on race, identity, socioeconomic status, and family life and included categories such as “white,” “military kid,” “parents are married,” “mentally healthy,” “cisgender,” “have your own bedroom,” “Christian,” and “able-bodied.” The district initially defended the lesson plan. […]  After backlash from military families who viewed the lesson as a baseless attack, the district backtracked and said the activity would be “revised.” Fairfax County Public School District “recognizes and honors the experiences of all our families, including those in service to our country in the military,” a district spokeswoman told The Federalist. “We have revised this activity. We apologize for any offense it may have unintentionally caused.”

Barone: Abolish Parenthood? No, Family Trumps ‘Equity’
“California should abolish parenthood, in the name of equity.” That’s the headline of a Ventura County Star column by Zocalo Public Square’s Joe Mathews. “Want true equity?” the San Francisco Chronicle headlined the same column three days later. “California should force parents to give away their children.”
The column’s thesis was not mischaracterized by either headline writer. (It’s a longstanding practice in journalism that reporters and columnists don’t write headlines. Nonjournalists find this bizarre, but that’s the way it has always been.) Mathews points out that advantaged parents pass on their advantages to their children. The “solution,” he says, is “making raising your own children illegal.” Or “universal orphanhood,” as he writes a few paragraphs down. “Handovers of babies” would be mandatory. In support, he cites the Greek philosopher Plato (children should be “possessed in common”) and California Gov. Gavin Newsom (policy should be formulated through “an equity lens”). […]  Mathews’ point is that a single-minded pursuit of equity means abolition of the family. But most voters reject that. Even Israel’s communal kibbutz movement sputtered out long ago. But some Democrats have been insisting “equity” comes before “family.”

The change, first reported on by Krebs on Security, will force users to sign into the IRS website through an account with third-party firm ID.me, and provide a government identification document with their photo alongside a selfie to verify their identity, according to the IRS website. The IRS first announced its partnership with ID.me in November, arguing the arrangement would “improve accessibility” and security for users. “Identity verification is critical to protect taxpayers and their information. The IRS has been working hard to make improvements in this area, and this new verification process is designed to make IRS online applications as secure as possible for people,” IRS Commissioner Chuck Rettig said at the time.

The Department of Homeland Security (DHS) has not officially released illegal immigration totals for December 2021. This week, though, the Customs and Border Protection (CBP) agency revealed in a court brief that nearly 180,000 border crossers were apprehended that month. Morgan said the number of border crossers and illegal aliens apprehended at the southern border last year, coupled with those who successfully illegally entered the U.S. and those who are immediately turned away by Border Patrol, is upwards of three million.

Brown: Senate Judiciary Committee Deadlocks on ‘Wild-Eyed Leftist’ Dale Ho
Dale Ho, President Biden’s judicial nominee to be United States District Judge of the United States District Court for the Southern District of New York, failed to secure a majority vote from the Senate Judiciary Committee on Thursday afternoon when Senators voted along party lines for an 11-11 vote with only Democrats voting to advance his nomination after Republicans excoriated Biden’s nominee. […] As Townhall has covered extensively, Ho has a track record of statements alleging that the United States Senate — the body debating his nomination and responsible for confirming him to the federal bench — is undemocratic. In addition, Ho has claimed that the Electoral College is also a tool of racism, and said Florida isn’t a democracy. Texas Republican Senator Ted Cruz attacked Ho’s lack of temperament to be a federal judge, pointing to the radical nominee’s choice to previously self-identify as a “wild-eyed leftist.” Ho hasn’t exactly portrayed himself as an independent arbiter of the law.

Murdock: Senator Kelly Breaks Long Silence, Supports End to Traditional Filibuster
Senator Mark Kelly (D-AZ) has decided that he supports ending the filibuster by modifying it through a “talking filibuster,” which would require senators to speak on the floor to block legislation instead of the traditional filibuster requiring 60 votes to proceed to a final vote.  In a statement, Kelly compared the Senate to NASA, implying that the decisive action of the bare majority should outweigh the hesitations of the minority. It is unclear whether Kelly considered the 1986 Challenger explosion before he offered that comparison to justify his decision — the Challenger rocket did make it off the launchpad, but only survived for 73 seconds before exploding and killing the seven passengers on board. It is also unclear whether Kelly considered the Biden Administration’s botched withdrawal efforts from Afghanistan late last summer, which caused the deaths of 13 service members at the Kabul Airport.
“As an astronaut and a combat veteran, I can tell you that if NASA or the Navy functioned like the United States Senate, we would never get the rocket off the launchpad and in combat we’d never complete the mission,” said Kelly. “Arizonans deserve a Senate that is more responsive to the challenges facing our country, which is why I’ve spoken with Arizonans and my Republican and Democratic colleagues about their views on what can be done to make this place work better. I’ve considered what rules changes would mean not just today, but years down the road, for both parties and all Arizonans.”
