The case, brought by Boulder County, Colorado against Suncor Energy and Exxon Mobil, seeks monetary relief for the companies’ decision to burn fossil fuels and allegedly “conceal” the associated dangers, which the county argues “caused, accelerated, an[d] exacerbated the impacts of climate change.” While the companies have appealed the case to the Supreme Court, it still has to decide on the question of jurisdiction, and whether or not the case should be heard in state or federal court. […] One pending climate case was brought by Honolulu, Hawaii. There, hearing the case at the state level would mean putting it before a Hawaii Supreme Court that ruled just last week that its citizens have a right to a “life-sustaining” climate.

DOJ: Six Additional Oath Keepers Members and Affiliates Found Guilty of Charges Related to Capitol Breach

Six additional members and affiliates of the Oath Keepers were found guilty in the District of Columbia today for their actions during the Jan. 6, 2021, Capitol breach. Their actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the presidential election. Sandra Parker, 63, of Morrow, Ohio; Bennie Parker, 72, of Morrow, Ohio, Connie Meggs, 60, of Dunnellon, Florida; Laura Steele, 53, of Thomasville, North Carolina; and William Isaacs, 23, of Kissimmee, Florida, were found guilty of conspiring to obstruct an official proceeding, a felony. Sandra Parker, Meggs, Steele, and Isaacs were also convicted of obstruction of an official proceeding, conspiring to prevent an officer of the United States from discharging a duty and destruction of government property, all felonies. All five defendants, along with co-defendant Michael Greene, 39, of Indianapolis, Indiana, were found guilty of entering and remaining in a restricted building or grounds, a misdemeanor. “With this verdict, the Justice Department has now secured convictions of 14 Oath Keepers members and affiliates for felonies surrounding the January 6, 2021 attack on the Capitol,” said Attorney General Merrick B. Garland. “I am grateful to the prosecutors, agents, and staff for their tireless work on these cases. The Justice Department is committed to holding accountable those criminally responsible for the January 6th assault on our democracy.”

Solomon’s suit was filed in U.S. District Court in Washington D.C. with help from the nonprofit America First Legal public interest law firm. It alleged that the two federal agencies were violating the Presidential Records Act by keeping the declassified Russia probe documents out of the Archives’ official collection for the Trump presidency. “This is a case about two government agencies apparently colluding to evade the Presidential Records Act,” the lawsuit said, asking the court to “recover the records wrongfully withheld and to force the defendants to comply with the law.”

Generally speaking, these censorship efforts were acquiesced in or supported by conservatives. Behind the banner of the Free Speech Movement that began in California in the 1960s, liberals stood as staunch allies of free speech, regardless of how repulsive or destructive that speech. Liberals continued that solid free speech defense through the 1990s and 2000s, although with cracks beginning to appear as they began succumbing to political correctness. It was liberals who strongly resisted a congressional attempt to regulate Internet pornography accessed by children, as well as state attempts to protect children from graphically violent video games. This probably marked the apex of the liberal defense of speech. For at least the past decade or two, the liberal position on free speech has eroded considerably, to the point where the political left has become the primary advocate for censorship across an array of speech issues.

A health-care executive who claims Jim Biden defrauded him was interviewed multiple times by the lawyer Joe Biden just nominated to serve as U.S. attorney for the Western District of Pennsylvania. According to two sources, while the Delaware U.S. attorney’s office is aware of the allegations, that office is not investigating the potential fraud, leaving the matter solely in the hands of the conflicted-future U.S. attorney. On Monday, President Biden named Eric Olshan, currently an assistant U.S. attorney in the Pittsburgh office, to fill the vacancy left open when former U.S. Attorney Cindy Chung was confirmed to the Third Circuit Court of Appeals. As I previously reported, Chung, whom President Biden had nominated to the federal appellate court, had been overseeing the criminal investigation into the bankrupt health-care business Americore—a business Jim Biden allegedly siphoned hundreds of thousands of dollars from to finance repairs for his beach house. Jim Biden is the current U.S. president’s brother. Now, President Biden seeks to replace Chung with Olshan, raising serious concerns about a potential conflict of interest given Olshan’s involvement in the investigation of the Jim Biden-connected business, Americore.

Authorities caution that there’s been a “sharp increase” in the trafficking of fentanyl mixed with xylazine, which is only approved for veterinary use. Also known as “Tranq,” xylazine “is making the deadliest drug threat our country has ever faced, fentanyl, even deadlier,” Administrator Anne Milgram said in a statement. Since the drug is not an opioid, Narcan is not effective in reversing its effects, DEA said.

The synthetic mRNA carried on lipid nanoparticles appears to be resistant to breakdown by human ribonucleases by design so the product would be long-lasting and produce the protein product of interest for a considerable time period. This would be an advantage for a normal human protein being replaced in a rare genetic deficiency state (e.g. alpha galactosidase in Fabry’s disease). However, it is a big problem when the protein is the pathogenic SARS-CoV-2 Spike. The adenoviral DNA (Janssen) should broken down by deoxyribonuclease, however this has not be exhaustively studied. This leaves dissolution of Spike protein as a therapeutic goal for the vaccine injured.

For as is always the case with these matters, Stein is criticized only for making a politically incorrect assertion involving race — and could suffer reputational and career death because of it — when the real issue is this: was he correct or not? Both books deal with Millennials, the generation usually defined as anyone born between 1981 and the mid-90s, and the author, who taught English at Emory University for many years, has had a good look at this generation. Twice in the last decade, Supreme Court justices have written decisions criticizing “cy pres,” a legal dodge that enables trial lawyers to divert hundreds of millions of dollars of class-action settlement money from consumers to nonprofit advocacy groups, frequently in favor of leftist causes. This mechanism permits lawyers to hijack valid class actions, leave the actual class members with nothing, while providing a funding stream for the Left. But so far, the Court as a whole has yet to decide the issue, waiting for the right case. My firm has two such cases, St. John v. Jones and Yeatman v. Hyland; this spring, the Court will decide whether to hear our cases, which the SCOTUSblog website called “Petitions of the Week.” In “Law French,” cy pres (pronounced sigh-PRAY in America) means, roughly, “as near as possible.” As a legal doctrine it typically applies to charitable trusts that have outlived the cause for which they were established. For instance, cy pres permitted the March of Dimes to continue operating, after the invention of the polio vaccine, with a change in institutional focus to other childhood diseases. While sometimes appropriate in the trust context, cy pres’s application to class-action suits enables attorneys to bilk their clients by claiming it would be too difficult to distribute the money to class members.Cy pres offers a conflict of interest that attorneys find too tasty to resist.

Levitt: Hezbollah Infiltrates Israel (Part 1): Another Step Toward Changing the Rules of the Game

Earlier this month, a terrorist operative infiltrated Israel from Lebanon, crossing the UN-demarcated Blue Line and evading border patrols and remote detection systems. After traveling sixty kilometers south to the Megiddo junction, he planted a sophisticated improvised explosive device of a type typically used by Hezbollah, which seriously wounded an Arab Israeli citizen upon detonating. He then hitched a ride from a passing car while security forces led a manhunt. When authorities stopped the car near the border town of Yaara, the driver exited the vehicle but the terrorist refused. Armed with an explosive belt and other weapons, he was soon shot dead. Authorities have yet to release their findings on the suspect’s identity, but the military and the Shin Bet intelligence service believe he was operating on Hezbollah’s behalf. The attack was claimed on Telegram by a previously unknown group calling itself “The Galilee Forces—the Lone Wolves,” which also posted pictures of various Israeli locations and officials with the caption “the next targets.” Yet authorities appear to view this claim as propaganda intended to distract from Hezbollah’s role—after all, little transpires across the border without the group’s consent, and the device used in the attack is a type associated with Hezbollah, not Palestinian groups.

AFP: Saudi Arabia declares Ramadan to start Thursday

Saudi Arabia, home of the holiest shrines in Islam in Mecca and Medina, has announced that the fasting month of Ramadan will start on Thursday. The kingdom’s supreme court ruled on Tuesday evening that the Islamic calendar month of Shaban, which precedes Ramadan, will end on Wednesday, meaning Ramadan will begin the following day, the official Saudi Press Agency reported.
