As of 5:00 a.m. Eastern Time on November 3, The New York Times had called 45 districts for Democrats in the Virginia House of Delegates elections and 45 for Republicans, with 10 seats remaining too close to call. Two incumbents—Chris Hurst (D) and Roz Tyler (D)—were defeated. All 100 seats were up for election. Because Glenn Youngkin (R) won the gubernatorial election and the state Senate—which currently has a Democratic majority— was not up for election, Virginia will have divided government regardless of which party wins control of the House. Democrats won control of the House in 2019, ending a 20-year Republican majority.

The Supreme Court on Monday ordered New York’s top court to reconsider its ruling against a coalition of charities that challenged the state’s mandate that employers cover abortions in their employee health insurance plans. The Supreme Court declined to take the case of the Diocese of Albany v. Emami in light of a major ruling it handed down earlier this year siding with a Catholic charity in Philadelphia that declined to screen same-sex couples as foster parents. […] “We are gratified and grateful that the Supreme Court has recognized the serious constitutional concerns over New York State’s heavy-handed abortion mandate on religious employers,” Bishop Edward B. Scharfenberger said in a statement.

According to the Washington Post, a majority of Supreme Court justices seemed willing to allow a challenge by abortion providers to the Texas law, which bans most abortions after six weeks of pregnancy and allows enforcement by private citizens. Based on the Post’s reporting of the questioning by Justices, it does seem that the Court will permit that challenge. In fact, it looks like the Justices will do so by a 6-3 majority. That’s also Ed Whelan’s view. He expresses his dismay here. […] The six Justices who seemed willing to allow the abortionists’ challenge to proceed include the three leftists — Justices Breyer, Sotomayor, and Kagan — as well Chief Justice Roberts. Michael Anton, a senior fellow at the Claremont Institute, published The Stakes last summer in anticipation of the 2020 election, which he described as a highly consequential “point of no return” for America. The book is being released this week as a paperback, and The American Mind is pleased to publish Anton’s preface to the new edition. Since the book was published in an election year and intended to influence the outcome, a potential reader may reasonably ask, “Now that the election is over, why should I read this?” The answer is that the recommendation to vote for Trump culminates from an analysis that is truer to America’s present and future than it would have been had Trump remained president. The America of 2021 is the America of 2020, only more so, and the country will continue in this direction for the foreseeable future. The trends that Trump might have reversed, or at least slowed, are now barreling forward full speed ahead. The Stakes is intended as a work of political science. It offers an analysis of the American regime: what it was designed to be and once was (Chapter 2), and what it now is. The book does not presuppose but attempts to show that the government of the founding fathers, of the Declaration and Constitution, of some two hundred years of continuous operation, is today but a memory. While formally still the law of the land, that regime has in practice been repealed and replaced. I describe our present regime in detail in Chapter 3.
