The Unpersoning of John Eastman

John Eastman is a legal scholar of the first rank. He has argued before the Supreme Court, testified in Congress, and cultivated a deserved reputation as an expert in constitutional law. He has practiced at a prestigious law firm, served as both professor and Dean at Chapman University law school, and, of course, represented many notable figures, including Donald Trump. Unlike many lawyers, he earned a reputation for integrity, intelligence, and moral courage. Like all lawyers, he maintained a bank account with a major financial institution and, of course, a state license to practice law—in his case, in California, one of the hardest bar licenses to earn. Those sound like the trappings of a good life—the reputational and material fruits of a lifetime of honest hard work. It used to be the case that once earned, such fruits were then possessed of right. And no person—certainly no American—would dare to deprive Eastman of his right to them merely because of his legal work or political speech. Indeed, it was not so long ago that even suggesting as much would have been considered un-American. Not any longer.

Today, extremely powerful people in government, high-finance, big law, big business, state bar associations, academia, and elsewhere have decided to destroy John Eastman because of his legal work and political speech on behalf of Donald Trump in late 2020 and early 2021. Some hated his courageous challenge to “their” democracy. Others feared his intellect. Still others saw an opportunity to increase their middling stature by bringing low a greater mind, while fantasizing that by disagreeing with Eastman they fulfilled an “oath to God.” All have worked to destroy Eastman because he challenged the regime.

Rep. Harriet Hageman (R-WY): On April 26, I joined as an original cosponsor of H.R. 8147, the Repealing Big Brother Overreach Act, which will repeal the Corporate Transparency Act (CTA) passed by the Congress in 2021. While a recent court case declaring the CTA unconstitutional has raised some hope of blocking this bill judicially, the Biden Administration is expected to appeal the ruling or restrict the amount of companies exempted from the CTA’s reporting requirements. Until that court case is finalized, or H.R. 8147 becomes law, small businesses across the nation are under threat. Passed in 2021, the CTA was intended to target shell companies used for criminal purposes. Yet despite its best intentions, this bill institutes confusing, complex, excessive reporting burdens on any business with 20 or fewer employees and less than $5 million in annual revenue – essentially every small business in America. Those who fail to comply with reporting requirements could be fined $500 per day up to $10,000, and up to 2 years in federal prison.

Sibarium: ‘Irrevocably Shaken’: Editors of Columbia Law Review Demand Cancellation of Exams, Citing Trauma Caused by Police Presence on Campus

The student editors of the Columbia Law Review issued a statement on Wednesday urging Columbia Law School to cancel exams in the wake of the police operation that cleared the university’s unauthorized encampment, saying the “violence” had left them “irrevocably shaken” and “unable to focus.” The statement, which represents the majority opinion of the editorial board and was endorsed by five other law journals, including the Columbia Human Rights Law Review & A Jailhouse Lawyer’s Manual, accused the police of “brutalizing” students—though no major injuries have been reported—and claimed that canceling exams was a “proportionate response” to the “distress our peers have been feeling.” […] “The current exam policy raises concerns around equity and academic integrity,” the statement said. “Many are unwell at this time and cannot study or concentrate while their peers are being hauled to jail.” The statement also accuses members of a “white supremacist, neo-fascist hate group” of “storming” campus—an apparent reference to a pro-Israel rally organized by Christian Zionists, including the evangelical musician Sean Feucht, who gathered outside of Columbia’s gates on April 25 for hymns and prayer.

Firstly, those supposedly “peaceful” marchers against Israel pose a real threat to Jews; secondly, in attempting to protect Falter himself (under threat of arrest), the Met showed how it was failing to protect Jews in general.
