The roadmap for systemic censorship is receiving little attention because the Court punted on the substance of the issue. The Supreme Court’s confounding 6-3 ruling for the Biden administration in Murthy v. Missouri (previously, Missouri v. Biden), frees the administration to expand its whole-of-government censorship enterprise. Contrary to the insincere assertion in Justice Amy Coney Barrett’s majority opinion that the Court lacks jurisdiction to reach the merits of the dispute, her opinion does just that, adopting the tone and principles of the three liberal justices who joined in the majority. It is disquieting that Barrett, John Roberts, and Brett Kavanaugh, who also joined the majority, have embraced far-Left nomenclature. From selecting euphemisms such as “content moderation,” in lieu of “censor” or “suppress,” to scenarios that are contrary to the evidence and findings of the lower courts, inferences favorable to the administration, and a rejection of plaintiffs’ thesis that government coercion is a “but for” cause of instances of censorship, the majority presents the administration as a passive player in its censorship juggernaut.

Piper: Platforms over people? SCOTUS decisions make social media censorship easier than protecting speech

Justice Alito’s concurrence reads more like dissent, [and] says Kagan’s opinion “unreflectively assumes” that platforms who “use secret algorithms to review and moderate an almost unimaginable quantity of data” are same as “newspaper editors who marked up typescripts in blue pencil 50 years ago.” Whose First Amendment rights are more important, those of individuals or corporations? A pair of Supreme Court rulings days apart raised legal-standing hurdles for individuals to sue public officials for pressuring online platforms to censor their viewpoints and First Amendment hurdles for governments to protect viewpoints against platform censorship. While both cases are heading back to lower courts for further development, the rulings may give Americans the impression they have little recourse against infringements of their digital speech, in the courts or at the ballot box, with four months before the presidential election.

Earlier this month, the Seattle Police Department became the latest major law enforcement agency to open recruiting to illegal aliens, and if hired, these new cops will end up having more gun rights than everyday Americans. Under this new hiring policy, illegal aliens protected from deportation under the Obama-era DACA program will be eligible to apply. Of course, should these aspiring officers pass the training academy, they will be sworn to uphold the Constitution and laws of the United States and empowered with the full authority of the law, including the authority to arrest, execute warrants, and carry service weapons. Many readers may not be aware that a series of federal laws exist that exempt active and retired police officers from state and local gun control laws when carrying off-duty and in restricted areas […] While it sounds like a great idea at first glance, there’s a serious constitutional question that’s being ignored: Why should a certain class of people be given special rights that all Americans can’t enjoy—especially when that class of individuals may now include illegal aliens?

Clarence Thomas questioned Jack Smith’s authority because he was a private citizen when he was tapped as a special prosecutor. “I write separately to highlight another way in which this prosecution may violate our constitutional structure. In this case, the Attorney General purported to appoint a private citizen as Special Counsel to prosecute a former President on behalf of the United States. But, I am not sure that any office for the Special Counsel has been “established by Law,” as the Constitution requires. Art. II, §2, cl. 2. By requiring that Congress create federal offices “by Law,” the Constitution imposes an important check against the President — he cannot create offices at his pleasure. If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President,” Clarence Thomas said. Sundance: Supreme Court Rules President Trump Has Absolute Immunity for Official Actions Within Constitutional Authority

As expected, the high court instructed the lower trial courts to hold specific evidentiary hearings on each anti-Trump criminal count, and determine which counts, if any, related to official or unofficial acts. The Supreme Court is essentially telling the lower courts to go back and look at each citation and review which claims are official acts and which claims related to unofficial acts. The Supreme Court ruled that presidents may not have immunity for non-official conduct. However, when the judicial review cannot differentiate, the court cannot look at motives for the decisions.

“In dividing official from unofficial conduct, courts may not inquire into the President’s motives,” the Court ruled. “Whenever the President and Vice President discuss their official responsibilities, they engage in official conduct.” “The indictment’s allegations that Trump attempted to pressure the Vice President to take particular acts in connection with his role at the certification proceeding thus involve official conduct, and Trump is at least presumptively immune from prosecution for such conduct,” the Court added. “The President enjoys no immunity for his unofficial acts, and not everything the President does is official. The President is not above the law. But under our system of separated powers, the President may not be prosecuted for exercising his core constitutional powers, and he is entitled to at least presumptive immunity from prosecution for his official acts,” the Court concluded. “That immunity applies equally to all occupants of the Oval Office.”

Kennedy: The Diminishing Likelihood of a Fair Election

China and the vulnerability of the U.S. election system. It is not the purpose of this essay to discourage anyone from participating in the 2024 election. Quite the opposite. Its purpose is to encourage unprecedented numbers of citizens and their elected representatives to work together to ensure that the election will be fair and free from, among other things, interference by foreign governments and their intelligence agencies. At no time during the Cold War with the Soviet Union was it imagined that the Russians could manipulate a United States presidential election in favor of their preferred candidate. Hollywood’s portrayal of a “Manchurian Candidate” aside, American elections were held in person, using paper ballots, counted by human beings, with other human beings watching them. And, however vicious and corrupt the normal partisan interplay of American politics may have been, this practice insured that a fair enough election could be held. Today that is no longer the case. Regardless of who the nominees are in 2024, just as in 2020, much of America will hold their elections in the least transparent, most vulnerable method possible: absentee ballots. Because of this, a free and fair election cannot be assured. It matters not that President Trump is ahead in all the polls and in ways that some pollsters believe cannot be overcome. Citizens should expect that, since America is in a war with Communist China, November’s election will be the target of a massive intelligence operation to decide the next president.

Schmad: Judge Rejects Biden Admin’s Effort To Dismiss Case Alleging It Funded Palestinian Terrorists

A federal court on Friday denied the Biden administration’s effort to dismiss a lawsuit alleging that it had illegally subsidized Palestinian terrorism. The lawsuit, first filed in December 2022 by Republican Texas Rep. Ronny Jackson and victims of Palestinian terrorists, claims that the administration violated the law by reinstating aid to Palestinians and allowing funds to flow to a program that pays stipends to imprisoned terrorists as well as their families. The U.S. District Court for the Northern District of Texas  ruled that there is sufficient evidence the Biden administration maintained its funding to the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) after Congress sanctioned the organization over its ties to Hamas for the case to proceed.

Shaw: Arab Scholar: Hamas Isn’t ‘Terribly Interested’ in a Ceasefire

While most of the media seems to still be focusing on Thursday’s presidential debate, it’s worth remembering that there are still a couple of wars going on, largely without any competent management from the United States in our previous role as a leader in global affairs. The one in Gaza isn’t showing signs of ending any time soon, despite Hamas having been offered several opportunities for a ceasefire in exchange for the release of hostages and a cessation of their rocket attacks against Israel and other people in the region. What may not be obvious to many of us is why Hamas would continue to reject these opportunities when they are so clearly being obliterated by the IDF every time they are identified. NPR’s Danielle Kurtzleben recently conducted a good interview with Hussein Ibish of The Atlantic who is a a senior resident scholar at the Arab Gulf States Institute. He shared his insights about the leadership of Hamas and what their motivations and strategies might be at this stage of the war. Schrupp: Newsom brags about California job growth, new report finds it is all government

California’s state-funded, non-partisan Legislative Analyst’s Office found the private sector lost 154,000 jobs and the public and public-supported sector has gained 361,000 jobs since the peak of the state’s labor market in September 2022. This means on net, the state’s 207,000 job increase in employment since September 2022 has been from growing government-related hiring.

A Midwestern Doctor: We Now Have Proof the Covid Vaccines Damage Cognition

. . . there were a variety of reasons to suspect they would cause autoimmune disorders, fertility issues and cancers—but for some reason (as shown by the Pfizer EMA leaks), the vaccines had been exempted from being appropriately tested for any of these issues prior to being given to humans. Likewise, the published clinical trial about Pfizer’s vaccine also showed adverse reactions were dramatically higher with the second rather than first shot. •Once the vaccine became available to the general public, I immediately had patients start showing up with . . . •About a month after the vaccines were available to the public, I started having friends and patients share that they’d known someone who had unexpectedly died suddenly after receiving the vaccine (typically from a heart attack, stroke, or a sudden aggressive case of COVID-19).
